2022 case dismissed, 2023 case police report rejected and now he is arrested in 2024 for the same charge

 

Ryan Thomas Weinert was arrested by HCSO yesterday and booked for PC 273.6 (a) violating a restraining order as a misdemeanor. This is listed as a new arrest for 2024. Weinert posted bond.

Weinert's family law case is mentioned in the notice of formal proceedings filed by the Commission on Judicial Proceedings against  Gregory Kreis who is currently on vacation and not returning to Humboldt Superior Court as a judge. Voters kicked Kreis to the curb in the March 2024 election.

A 2022 case for the same charge against Weinert was dismissed, the same charge in a 2023 case was never filed by the DA and rejected.

Alleged rapist Baila Wane's preliminary hearing scheduled on 4/30 was already  continued once to 5/2 because the officer was sick. It was continued again to 6/4 because investigation was needed. Both times by the DA.

People made oral motion to continue. Since preliminary was continued beyond the 10 day waiver, Wane released with conditions. 

The DA charged Wane with Count 1 PC 261 (a) (3) rape of a victim inapable of consent due to intoxicating, anesthetic or controlled substance and Count 2 PC 261(a)(2) forcible rape of a minor.

I saw the rally, I heard the chants a while back. "No Justice, no Peace", "No racist police" "Israel os a racist state", "Israel is a para state." There are other signs. The protests and chants have received a lot of coverage. There is no new information to cover about the protest today. I don't recognize or see any of the students and ralliers I spoke with on Tuesday. At 5:25,  people with signs were still walking up to the 5th street court entrance. They could be students but seemed more like supporters from the community. Deputy DA Roger Rees is here on his own time. Neither side is engaging each other.

Between cars honking support at both sides, its noisy and I don't know who this guy is but his screaming random angry baiting insults about Muslims and fences and is being ignored. Seems more like an opportunist but then so are the politicians, local, statewide and nationally. Today, cars honked in support of the protestors but there were also few people who also did that in support for Mr Rees. A driver pulled over in rush hour traffic to speak with Mr. Rees.

The bigger story is will Cal Poly Humboldt administration, Mike McGuire Jim Wood continue to ignore the letter from Jewish leaders, continue to ignore how they have failed the Cal Poly students, this community over the years. These protests highlight struggles and frustrations beyond the current situation in Israel and Gaza. 

With Michael Acosta no longer allowed to practice law, Sarah Carroll needs a new attorney so hit and run preliminary delayed

 

On 5/1, Sarah Carroll's preliminary hearing hearing for her 2023 hit and run case was continued to 6/11. On 4/22, a document was filed. It is listed as  920 (a) (4) compliance. Public Defender's office was appointed on 5/1. Confirmation of counsel is on 5/29.

KRCR reporter arrested for DUI

 

I compared the date of birth from jail records and 24 year old Adelmi Yazmin Ysita arrested by California Highway Patrol at 3:10 a.m for VC 23152 (a) andVC 23152(b) bac over legal limit is the KRCR KAEF reporter detained on Cal Poly campus earlier this week. She was released on OR. CHP PIO Paul Craft told me, "This arrest occurred on Myrtle Ave south of Park St., in Eureka."

I have reached out to KRCR Assistant News Director Nazy Javid, News Director Kerry Loring and General Manager John Manzi. On behalf of Sinclair Broadcasting, spokesperson Jessica Bellucci responded, "Hi John-Adelmi is currently on leave from the station. This is a personnel matter, and we can’t comment further. Thank you for understanding."

Considering what happened to Adelmi on the Cal Poly Humboldt campus earlier this week with illegal detention by two officers listed as Cal Poly Humboldt police, I want to know more about this California Highway Patrol arrest. I have reached out to Adelmi if she wishes to comment. 

Lassen Superior Court Tony Mallery removed from office by CJP

Today, the Commission on Judicial Performance issued a decision and order removing Lassen Superior Court Judge Tony R. Mallery from Office. His behavior and fighting the CJP despite overwhelming evidence is what led to the result today. Mallery was also charged with 21 counts of misconduct and had a notice of formal proceedings filed against him.

This disciplinary matter concerns Lassen County Superior Court Judge Tony R. Mallery.  The commission commenced this inquiry with the filing of its Notice of Formal Proceedings (Notice) on September 12, 2022. Judge Mallery is charged with 21 counts of misconduct, which, with subparts, include 81 allegations of misconduct.  The allegations involve discouraging court staff from cooperating with the commission and retaliating against those who did; false representations to the commission; usurping the role of prosecutors and attempting to eliminate plea bargaining in criminal cases; making judicial decisions based on improper considerations; improperly denying peremptory challenges and retaliating against attorneys who filed them; making comments to other judges that might interfere with a fair hearing; engaging in speech and conduct that could be perceived as biased; poor demeanor toward court staff; making disparaging remarks about a fellow judge and court staff; and failing to disclose or disqualify when required. "

Trying to use his position to find out who was "ratting" on him, retaliation against attorneys who disqualified him, refusing to disclose affiliation and recuse himself from a case, anyone getting deja vu?

So County, HCSO or media would have been vilified but this guy can post an unsubstantiated photo and information online and face no consequences?

 

Criminal proceedings suspended in former Humboldt Superior Court assistant operations manager's cases

 

At her OR/bail hearing on 4/29, criminal proceedings were suspended in the two 2024 cases against former Humboldt Superior Court assistant operations manager Socorro Cervantes. Future dates were vacated. Dr. Rassi reports are due on 5/29. 

John Provolt resolves indecent exposure case for lesser charge, one year probation and ordered to stay away from Good Relations

 

Yurok Tribe member Sherri Provolt's son John Provolt resolved his indecent exposure case on 4/29. The bench warrant was recalled. The subsection in the court minutes is difficult to read but it looks like John Provolt pleaded guilty to PC 647 (a) lewd conduct in public which is a misdemeanor. Judge Kaleb Cockrum sentenced Provolt to 1 year probation and ordered him to stay away 100 yards from Good Relations. He can drive by or walk on the other side of the street.

Ms. Andrea Sullivan is Provolt's attorney. Deputy District Attorney Andrew Truitt appeared on the case for the People.

Suspicious item in passenger's luggage caused temporary closure of terminal and security checkpoint at airport today

The terminal and security check point at the California Redwood Coast Humboldt County Airport (ACV) were closed at approximately 3:45 p.m. today, Wednesday, May 1, due to a security concern related to a suspicious item in a passenger’s luggage. This temporary closure was in place out of caution while Transportation Security Administration (TSA) agents and the Humboldt County Sheriff’s Office investigated the issue.

Sequoia Park Zoo Foundation announces early resolution of $300K loan

 

The Sequoia Park Zoo Foundation (SPZF) announced its decision to dissolve on April 12, 2024. In winding up, SPZF is settling outstanding liabilities in a good faith effort to ensure the ongoing success of the City of Eureka’s Sequoia Park Zoo.

DA claims bite marks on Mia's arm cannot be distinguished, defense to subpoena criminalist who prepared DNA report

 

Yesterday, at trial confirmation for murder suspect Daniel Dozier, Deputy District Attorney Roger Rees and Ms. Andrea Sullivan both confirmed the 5/13 jury trial but with some caveats and comments from Ms. Sullivan and then a response from Judge Joyce Hinrichs,  whether it will proceed on that day is uncertain. Time estimate given by Mr. Rees is 3 to 5 weeks. Trial assignment is May 10.

Dozier is out of custody and sat in court with Ms. Sullivan, this was a few rows behind Mia Felder's parents. Before the case was called, Mr. Rees handed Ms. Sullivan some paperwork. There was no other media in court.

There was a third person there that night. Dozier's on and off girlfriend, Luccille Wetzel, who testified at the preliminary hearing. 

Allan Dollison recognized for one of top 100 jury verdicts in Los Angeles

Former Humboldt Deputy District Attorney Allan Dollison has vast experience in criminal and civil law and as a prosecutor and defense attorney. Mr. Dollison returned home to Los Angeles where he has won several successful verdicts as an attorney at the Law Offices of John C. Ye. Recently, Mr. Dollison received a plaque recognizing one of his verdicts among the top 100 jury verdicts which was also covered by the Daily Journal. I have included the case summary. 

Five busted in Marin County for being unlicensed and placing bids as high as $15,000 for residential work

No idea what happened to the Humboldt unlicensed contractors referred by the CSLB to the Humboldt County DA. I tried to find out but CSLB  issued a notice to appear in criminal court to five individuals from Novato.

Jail staff is busy enough and yet they work hard in helping people with information and are polite under stressful conditions. We have good people working in law enforcement and the courthouse they deserve recognition and not to be lumped in with the bad apples of this week.

The rest of the media routinely does nothing when court calendars are down, Vinelink is down, jail reports are down or court computers are down. The rest of the media all use it but as usual are lazy. Certain media outlets get promoted and funded because they have local, incompetent yahoos behind them who benefit from their selective coverage. The same fools who hold Humboldt back.

Where was the outrage when KRCR reporter was illegally detained? What did the rest of the local "media" do? Nothing as usual. Using "media" for most Humboldt grown "outlets" is an insult to the profession. KRFH did reporting that was vital and from the scene in this last week. That was journalism. 

Palavi Vainuku rearrested 10 days after he gets 3 cases dismissed and a plea despite multiple arrests and failures to appear

 

Palavi Junior Vainuku was arrested and booked by HCSO at 12:02 a.m. for PC 1203.2(a)(2) probation violation and HS 11350(a) possession of a controlled substance. There were numerous continuances before that plea. I wasted a lot of time following his other cases, he gets a plea on April 22 and is back in custody on May 1. He was released on OR.
