Brian Daniels who has four cases. Charges include criminal threats, DUI and hit and run. I have only seen him at one hearing. Based on his age, Judge Christopher Wilson indicated a willingness to grant him probation.
Today, things got better for Daniels. Due to COVID 19, first only one jury trial was being held. Daniels pulled his time waiver. There was an extension of 30 days Even with two jury trials, there is a backlog. Time runs out for Daniels on March 16. His jury trial for March 8 was rescheduled for that date.
Daniels refused the People's offer. His attorney, Deputy Conflict Counsel R.J. Leohner has been negotiating and has more leverage, as time passes.
The latest defense offer id to plead to Count 3 in his felony case and resolve other misdemeanors. If the case does not resolve and Daniels' trial does not proceed on March 16, Judge Kaleb Cockrum told Mr. Leohner he can file a motion to dismiss. This would be based on Daniels' right for a speedy trial. That motion would be heard on March 17 by Presiding Judge Joyce Hinrichs.
Daniels' is not the only defendant whose attorney will be filing such a motion. I heard the same thing in other cases at trial assignment today.
