Sexual battery suspect throws fit in court


Trial confirmation for sexual battery suspect Elhadji Ba was continued for a second time today. 



Deputy Conflict Counsel R.J. Leohner told Judge Timothy Canning that he is still awaiting court transcripts from the first jury trial and needs time to prepare.

The third trial confirmation is scheduled for November 18; jury trial is on December 9.

An error led to Ba's case to be set within 30 days and not 60 days. Deputy District Attorney Stacey Eads brought this to the attention of the court and Mr. Leohner agreed.

Ba has not waived time and his a mistrial was declared for his first jury trial.  Ba wanted dates to be set sooner and threw a fit in court, pushing Mr. Leohner's hand away when he tried to calm Ba down.

Ba pulled a "Chadaningan", a term I used for Chad Smith. Ba, like Smith should be grateful to Mr. Leohner because his defense strategy resulted in a mistrial. Maybe Ba should give his court appointed attorney time to prepare or risk a conviction for the second jury trial.
