No offer by the People; sexual battery suspect Elhadji Ba expression in court spoke volumes
Trial confirmation was scheduled on November 4 for sexual battery suspect Elhadji Ba. This is the incident that happened at the Dollar store in Myrtletown. Mistrial declared for first jury trial.
Ba's attorney, Deputy Conflict Counsel said he was waiting on transcripts requested from the first jury trial. Mr. Leohner said they had not received an offer from the People. He requested another trial confirmation which was scheduled on Nov 7.
Mr. Leohner made an informal request for discovery for the pertaining to any mental health treatment records for the alleged victim Jasmine Covington and contact information for her case worker at the Youth Services Bureau.
The alleged victim is fine with her name bei g public, it is listed in the complaint and was stated in open court.
Deputy District Attorney Stacey Eads said that the request was "outside the scope" and requested a written motion. Judge Timothy Canning agreed with the People.
Jury trial is scheduled for November12.
11/7 update: Further trial confirmation scheduled for Ba. If anything changes, I will add to this post.
