Judge Canning ruled convicted sex offender's failure to register was not willful



After the preliminary hearing against Sok Khanna yesterday, Judge Timothy Canning did not hold the convicted sex offender to answer on the charge that he failed to register.

Despite the fact that Khanna has registered since 2012 and testimony by EPD Sgt. Shawn Sopoaga and EPD Records Specialist Mackenzie Coutts as well as a sex offender registration form signed by Khanna, Judge Canning said that the failure to register was not willful.

The case was prosecuted by Deputy District Attorney Jessica Watson. Khanna was represented by Deputy Public Defender Casey Russo.

Mr. Russo in his cross examination brought up that English was not Khanna's first language and that he had met the registration requirements except for this one time.

A Cambodian court certified court interpreter was present with Khanna.

Since his arrest, Khanna had been released and has been out of custody. He hangs out in front of the Courthouse on 5th street. His residence is on 4th street in Eureka.

  1. If he's registered before, there's no excuse to say he doesn't know how and the time line . Get tough court system-don't let this be used as precedent for other idiots to use as " no speakem -no understandm". Total spineless decision by the courts.
