Prosecution in Goldberg case just wasted an hour and we learnt nothing new


Steve Shapiro was in the hallway this morning. He was called by the prosecution when court started at 10:07.

This is the prosecution's idea of recalling witnesses. This is a witness that kept changing his answer depending on which attorney questioned him.

We heard an audio and saw a cell phone on a Fortuna Police body cam video of the February 2018. Now the prosecution is playing the video of Shapiro's interview with the District Attorney.

So far in about an hour, we learned nothing new except that Fortuna Police telling Shapiro, "This thing is going to trial in week in the body cam video.

We also got to see Fortuna Police Department laugh at Shapiro.

There has been nothing as of 10:56 that Deputy District Attorney Luke Bernthal has asked that has not been covered before.

After almost two hours of questioning, the only new information was beneficial to the defense. Shapiro said that Jon Goldberg never beat Rachel; that he had a feeling someday she would do something to drive him crazy. Shapiro said that Jon Goldberg married for loyalty but Rachel Goldberg threw him under the bus.

After wasting more time later this afternoon, calling DA Investgator Gary Cooper on the stand and showing the jury a 10 minute video of Cooper just driving from the Goldberg property to Rohnerville Road, the prosecution rested their case at 2:15.

Mr. Bernthal said, "except for some exhibits."

The ride from Goldberg's property to 3150 Rohnerville Road may be 36 miles but when is grieving and hurting over betrayal and then gets ambushed by seeing your wife's lover (who wasn't supposed to be there), that time doesn't dampen emotions.

Tim Smith was not supposed to be there. So the pre meditation will be hard to prove with zero testimony that Goldberg threatened Tim Smith.

Why did the District Attorney charge this as murder with such a weak case and sloppy investigation? Why didn't they work on a plea deal?
