In 20 minutes, Rachel Goldberg is expected to be the defense's first witness


Rachel Goldberg is sitting in the hallway with defense investigator Max Hadley.

Tim Smith's family glared at Rachel Goldberg outside the courtroom before her testimony.

She is expected to testify at 2:40 p.m. but Deputy District Attorney Luke Bernthal indicated to Judge Graham Cribbs that "there were issues to be discussed." The attorneys briefly met with the Judge during a break.

Rachel Goldberg did testify. She was on the stand for about an hour and a half. Fifteen minutes of that was cross examination by Deputy District Attorney Luke Bernthal that amounted to nothing.

There is a photo that Douglas Smith testified to that Rachel Goldberg took of himself, Jon Goldberg and David Goldberg. In that photo, Jon Golberg has a black holster but Douglas Smith never saw him take out a gun.

Douglas Smith said Rachel Goldberg took that photo. Let's see what Rachel Goldberg testifies to when asked.

Fortuna Police Department said there equipment was faulty on September 26 when they interviewed Rachel Goldberg and Frieda Smith.

Rachel Goldberg never testified at the preliminary hearing in which she was an alleged victim. Right now Count 2 and 3 in this trial are kaput.

So, unless the prosecution has something big we haven't heard yet, tomorrow's cross examination will be just more of the prosecution's stubborness.

Mr. Bernthal did not miss the opportunity to bring up the "grow" on Goldberg's property. There has been no charge filed but since the arraignment, Mr. Bernthal feels necessary to mention this irrelevant fact.
