Prior to this morning, District Attorney's office never contacted Rachel Goldberg's stepmother
Not only has the prosecution not proved any allegations of domestic violence from Jon Goldberg towards Rachel Goldberg, they have not proved that Jon Goldberg fired any gun around Rachel Goldberg on September 26.
The prosecution continues to prop up their pathetic case by the same failed strategy. It tanked on them, again this morning.
And put their own investigator in a tough spot.
Mr. Bernthal likes to make a big deal of the defense using one psychologist's report instead of another. They can do that just as the prosecution can. But the prosecution omits selective information that is crucial to Count 2 and 3 and it is okay?
Deputy Public Defender Casey Russo called District Attorney Investigator Gary Cooper to the stand. Previously, he testified for the prosecution.
Mr. Cooper confirmed he was the lead investigator for the prosecution in this case from the beginning.
In response to Mr. Russo asking him when he saw the text message from Rachel Goldberg to her step-mom on September 26 (in which Edwina Meyer refers to alleged domestic violence from Jon Goldberg and Ms. Meyer telling Rachel Goldberg to tell the hotel clerk this information), Mr. Cooper responded, "I can't tell you the exact date."
Mr. Russo asked, "When did you first contact Ms. Meyer?"
"This morning," said Mr. Cooper.
Mr. Cooper testified, "she (Ms. Meyer) wasn't aware of any domestic violence between Jon and Rachel."
Mr. Russo, then asked about the text message on September 26.
Mr. Cooper responded that "she said she only did it because she was scared for Rachel.
Meyer also said that "Jon did not fire a firearm around Rachel."
Mr. Russo was going to ask Investigator Cooper about a conversation in the hallway a few days ago with an EPD officer. Mr. Bernthal objected. Judge Graham Cribbs had a sidebar and we never heard why.
