Due to scheduling issues on part of the prosecution, defense calls some witnesses today



Deputy District Attorney Luke Bernthal said, "due to scheduling issues (for prosecution)," it was decided that the "best way to proceed would be to allow the defense to call some witnesses."

Judge Graham Cribbs told the jury that the People are expected to call "one, maybe two witnesses on Monday."

Three witnesses testified this morning. David Holland, a cell phone expert for the defense. His presentation was excellent with details and timelines of calls and text messages on September 26 involving Tim Smith Sr, Jessica Springer and Rachel Goldberg.

Holland is currently a computer forensic engineer at Facebook. Before that he was an associate doing cyber investigation at Kibu Consulting in San Francisco. Prior to that a consultant at another company in San Francisco. He was a detective in St. Cloud, Minnesota handling felony cases. Holland has a bachelor's degree in criminal justice and a master's degree fromPenn State University. Holland has previously testified as an expert in digital forensics.

The attorneys stipulated that instead of referring to the types of phones, Holland would refer to who the phone belonged to during the defense presentation.

The other two witnesses so far this morning have been William Crider, a PG and E Supervisor and Fortuna Police Lt. Matthew Eberhardt. Both witnesses' testimony was beneficial to the defense and made a dent regarding the testimony by Richard Evansizer and Timothy Roscoe.

Crider testified the doors to Tim Smith's truck were open. Lt. Eberhardt admitted that the crime log was not started until later, half an hour to an hour later, from the time law enforcement has arrived on scene.

The defense witnesses were ready, no waiting, testimony and questioning focused.

Mr. Bernthal's cross if Holland was more of the same prosecution pattern. His snappy comment before questioning Lt. Eberhardt after Timothy Roscoe's credibility was tanked today after the defense questioning was telling.

On cross, Mr. Bernthal's first statement to Lt. Eberhardt was, " I have questiins about this case."

More defense witnesses at 1:30 p.m. Two or three witnesses expected to testify. Considering the defense just found out yesterday that they had to present witnesses out of order yesterday, the fact that we had to break for lunch at 11 is understandable.

After lunch, the defense called Court reporter Sabriba Shaha and David Vegliano a friend of the Goldbergs as witnesses.

Just as we were ready to conclude for the day, the prosecution decided to call Officer Ryan Richardson. It's as if they have no clue and are so disrespectful of people's time.
