"The defendant now has that chance. He is now provided with a choice to improve his life." These words are on page 3 of Humboldt Superior Court Judge Lawrence's four page ruling on August 26. Nye was granted mental health diversion.
I have included that ruling and even if you did not read my previous coverage, it mentions the new case filed by the DA on 8/19 for possession of meth in jail. Deputy DA Brandon Boozari is the prosecutor for both cases.
Deputy Conflict Counsel David Nims was Nye's attorney. On August 24, I reported Joe Judge was appointed by Humboldt Superior Court Judge Steward because Conflict Counsel had a conflict.
8/31/26: Joe Judge has a conflict so hearing had to be continued to 9/1 for setting/appointment of new counsel for both cases. These conflicts should be checked before appointing private attorneys by the CAO's and wasting hearings and taxpayer money on certain attorneys making a court appearance where nothing is achieved.
