Convicted molestor Michael Franco's preliminary hearing for local case of alleged molestation continued at defense's request

Preliminary hearing was scheduled this morning for Michael Franco's 2018 alleged molestation case . He already has a prior conviction for lewd and lascivious act with a minor.

The case is being prosecuted by Deputy District Attorney Stacey Eads.  Mr. Russ Clanton is representing Franco.

Franco was also to be arraigned on a traffic infraction. That case was dismissed by the People today.

Today, in court, Mr. Clanton made an oral motion to continue the preliminary hearing and asked for a setting of preliminary hearing. That date is October 3.

The People waived written notice.

Mr. Clanton's office received some additional discovery from the People yesterday. "It is not voluminous discovery but it invokes signigicant issues in this case," Mr. Clanton told Judge Timothy Canning. "Mr. Franco had no idea of photos."

Mr. Clanton and his investigator Cisco Lassiter are traveling to Los Angeles later today for this case.

The additional discovery is a part of ongoing investigation by the People. Ms. Eads said there is additional information "forthcoming."

Fingerprint analysis was done on Franco's phone. Ms. Eads told Judge Canning  that information from electronic devices "have to be shipped to another entity" and she "cannot antcipate when the extract will be completed."

Franco is charged with five counts of PC 288.7 (b),oral copulation or sexual penetration  with a child 10 years or younger and four counts of PC 288 (a), Lewd Act Upon A Child. Alleged victim Jane Doe.

Special allegation of prior sex offense for Counts 6 to 9 jurisdiction Los Angeles (Norwalk).
