Defense challenges state hospital finding murder suspect Antone Aubrey being competent to stand trial
A hearing was scheduled this morning for report on custody status and a certification of competency for murder suspect Antone Aubrey. Aubrey was admitted to the Jail Based Competency treatment program on August 9. He was sent back to Humboldt and booked into the jail on September 4.
Mr. David Celli, who represents Aubrey told Judge Christopher Wilson "we challenge the finding of the State Hospital" and asked that Dr. Renouf be appointed to evaluate Aubrey.
Setting of date for the competency hearing is scheduled for September 27 at 10:15. When that hearing date is held, a doctor from the State Hospital and Dr. Renouf will provide expert testimony. Outside court, Mr. Celli told me that the burden of proof is now on the defense to prove that Aubrey is incompetent to stand trial.
Aubrey has gained weight, looks very different than his booking photo and was quiet in court.
