Trial setting for Kody Marcelli continued to same day as 995 motion

Kody Marcelli had a pre trial conference and trial setting scheduled for his 2018 alleged assault case today.

 There was a hearing scheduled on 9/25 that the defense requested to lodge preliminary exhibits with the court. Visiting Judge Terrence Boren allowed the defense to file the four exhibits today.

On 10/17, there is a hearing scheduled for a 995 motion filed by the defense today. Trial setting was continued to that date at the request of both the prosecution and defense.

Marcelli did not have to be present as a 977 waiver of personal appearance has been filed with the court. Alleged victim Gary Harner was in court.

The case is being prosecuted by Deputy District Attorney Roger Rees. Marcelli is represented by Ms. Heidi Holmquist Wells.
