Defense files 995 motion in Kody Marcelli case a day before trial setting

Kody Marcelli has a pre trial and trial setting conference scheduled on September 12 for his alleged assault case.

On 9/25, there is is hearing scheduled, application to lodge preliminary exhibits with the court filed by the defense on 9/10.

On 10/17, there is a hearing scheduled for a 995 motion filed by the defense today.

"A California Penal Code 995 motion asks the trial judge in a felony case to dismiss one or more of the charges. The defense makes the motion after a California preliminary hearing but before trial."

Charges:

The case is being prosecuted by Deputy District Attorney Roger Rees. Marcelli is represented by Ms. Heidi Holmquist Wells.
