Defense motion to reduce Andrew Cunningham's bail denied, Cunningham held to answer on all charges except one special allegation


Both parties had stipulated to Count 5, the pornographic images charge so that ruling was merely a formality.

The only special allegation that Cunningham was not held to answer was the for use of force. This is for Count 4.

Judge Canning did give some feedback that it was a difficult case. He used the words, "a bit more troubling" before ruling on certain counts. Judge Canning said that for a preliminary hearing, the bar is "pretty low".

"This case is not going to try well," said Mr. Robinson before addressing the issue of bail.

After Judge Timothy Canning made his ruling, the defense argued for a reduction of bail, the People opposed reduction of bail and asked for an increase. Defense motion to reduce bail was denied, so was the request to increase bail.  Bail remain 2.5 million.

Arraignment on information is September 27 at 8:30 a.m.
