"Every day he is out there is a prejudice to us," Deputy DA Trent Timm's compelling arguments on Ariel Sosa bail show why he earned the nickname "Hotshot Deputy DA"

(Ariel Sosa)

(Abdiel Sosa)

Motion to increase bail, motion to examine source of bail as well as motion to amend complaint was scheduled for Ariel Sosa today.

For Abdiel Sosa motion to amend complaint and review status was scheduled. Both are currently out of custody and both are represented by attorneys from the Clanton Law Firm.

No other media was in court prior to the case being called on record so while some  of the remarks by Deputy District Attorney Trent Timm and Mr. Russ Clanton were on record,  others were not. "Every day he is out there is a prejudice to us," Mr. Timm told Mr. Clanton in response to the defense request for a continuance.

Mr. Timm said he was going to ask Judge Caning to make a preliminary finding on the source of the money for Ariel Arguelles Sosa's bail and ask that Sosa be remanded into custody. This based on the information included in the People's motion to increase bail.

Mr. Timm flat out said that Ariel Arguelles' source of bail was drug money. This was during the off record chat between Mr. Timm and  Mr. Clanton which took place inside court.

On record, Mr. Timm said that the date to set bail was set last Tuesday, in court to suit Mr. Clanton's schedule. Mr. Timm said that Mr Clanton's associate, Mr. David Celli appeared for him in court last Tuesday. Mr. Celli called Mr. Clanton to tell him about the People's motion to examine the source of bail.

Mr. Timm said he received an email from Mr. Clanton at 9:11  p.m. yesterday about a continuance.

On record, Mr. Timm told Judge Timothy Canning, "If the Court is prepared to grant the motion to continue  despite no good cause, I ask the Court to make a preliminary finding on source of bail and take the defendant into custody."

Judge Canning said, "I understand the People's concerns. The Court is also adequately concerned that the defense needs time to prepare."

Judge Canning granted the defense request for a short continuance.

People's two witnesses include two officers from the Humboldt County Drug Task Force. One of them is fomer DA Investigator Jack Bernstein.

The motions were continued to August 24 at 9:15.

The nickname for Mr. Timm was coined by Ryan Hurley during a court conversation.

In his arguments, Mr. Clanton said he was away in Los Angeles last week for another case and needed more time to meet with Ariel Sosa and an interpreter and to gather documents and file an opposition to the motion to examine source of bail.
