Mixed verdict in 2020 case, 1 count guilty, 2 counts mistrial

 


Mixed verdict in Courtroom 5 early this afternoon in a 2020 case, People vs Dennis Burriesci. Count 1 PC 29800 (a) (1) felon in possession of a firearm, mistrial because jury unable to reach a verdict. Count 2 HS 11370.1(a)  possession of a narcotic controlled substance while armed, mistrial because jury unable to reach a verdict. Count 3 HS 11350 (a) possession of a controlled substance, guilty.

Retired Judge Christopher Wilson presided over the trial. There have been a few mixed and not guilty verdicts this summer. Deputy District Attorney Ian Harris was the prosecutor on this case. Deputy Public Defender Adrian Kamada represented Burriesci. Court minutes were finally updated on 9/27 which I will add soon. The case is set for retrial. Trial confirmation on 1/17/24; jury trial on 1/29/24.

In November 2020, Humboldt County Sheriff’s deputies on patrol in the Loleta area conducted a traffic stop on a vehicle in the area of Montgomery Street and Eel River Drive. Burriesci was on probation, a search led to his arrest for firearm and drug charges.

9/25 Court minutes:



1/17/24: Trial date confirmed. Time estimate 5 days. Another case PD recuses Judge Kaleb Cockrum. Jury trial scheduled for 1/29/24.

1/29/24: Attorneys waiting on trial transcript.  Defense will file motion to continue; jury trial vacated. Trial setting on 2/20.

2/20: Defense waiting for trial transcripts for motion to suppress. Trial confirmation on 5/20; jury trial 6/10.
