Citizens for a Better Eureka third letter about CEQA? Crickets from Eureka Housing for All on signature certification?


I have not reported in a while on the two petitions filed by Citizens for a Better Eureka against the City of Eureka because there have been no updates. These petitions were filed before the campaign for recent initiative sponsored by Eureka Housing For All. Today, a request for hearing was filed in the second petition filed later but there weren't details or a date for an actual hearing available in e court when I checked today. I heard another letter was sent to the City of Eureka from Citizens for a Better Eureka, also about CEQA and will be checking on my own if a third petition was filed. I  contacted City of Eureka Attorney Autum Luna and spokespersons for Citizens for a Better Eureka. 

The third Citizens for a Better Eureka petition would  challenge "the City’s June 20, 2023 approval of a “Resolution of the City Council of the City of Eureka Finding the LINC Housing Project Sites Are Exempt Surplus Land Pursuant to California Government Code Section  54221(f)(1)(A) Because the Properties Are to Be Disposed of For Housing Development Pursuant to California Government Code Section 37364”, which appeared as Item F.6. on the City Council’s June 20, 2023 agenda."

I heard back promptly from Ms. Luna. "You are correct that this is the second of two current CEQA lawsuits filed by Citizens for a Better Eureka (CBE) against the City of Eureka. I am aware that Petitioners CBE filed a routine Request for Hearing in this case on June 24, 2023, but I have yet to receive notice of the setting of that hearing from the court.  You are also correct that the City of Eureka received a third letter of intent to initiate a CEQA lawsuit from CBE yesterday. "

Gail Rymer, spokesperson for Citizens for a Better Eureka emailed me and said she would get back to me by Monday.

Previous coverage can be accessed via links  included in yesterday's post on the initiative getting sufficient signatures. It is expected to be on the agenda for the October 17 Eureka Council meeting. Eureka City Manager Miles Slattery said they have 30 days since the signatures were certified.

I find it interesting that there has been no press release about the signature verification or coverage by other local media. Times Standard finally posted an article 24 hours later. As usual, only after I reported on it first. 

Usually Eureka Housing For All sends out a press release quickly. Even though the elections office had more time to certify these signatures by the required deadline, they did it sooner. That is one County department that should be the example all departments should follow and it is a testament to the leadership and staff and their professionalism.

If there has been any gloating on Facebook by John Fullerton who is the only one who pipes up online constantly speaking up for the right of the parking entitled, I wouldn't know nor do I care because it isn't an official statement from the campaign or spokesperson.
