Man with gun violence restraining order resolves second case for mental health diversion

 


Today, at trial assignment, after Judge Kelly Neel met with attorneys in chamber, mental health diversion was granted in the second case against  James Leach and he was ordered released from custody.  The jury trial scheduled for 8/7 was vacated. This is in the Eureka Police Department case. Last month, the HCSO case was dismissed by Judge Kaleb Cockrum. Leach has a two year gun violence restraining order against him which was requested by EPD and granted by Judge Timothy Canning.

Victims were consulted. They were fine with mental health diversion but concerned about Leach being released. There is a protective order in the EPD case and Leach has to stay 25 yards away from Jeff Holland and Allison Arkley Holland, their property and their housekeeper Rosa Reed. Leach is the Holland's neighbor. He said in court that he would not even drive by their home. Leach broke into local attorney Allison Jackson and her husband Peter Ranken's house with a firearm in each hand. 

Judge Neel stressed the no contact and told Leach that a treatment provider has to agree and he has to comply with a treatment plan and that diversion would be granted for two years once the court makes the order. I covered the case in detail and Mr. Timm restated what he did at the conclusion of the preliminary hearing.

Deputy District Attorney Trent Timm is the prosecutor. Deputy Public Defender Casey Russo is Leach's attorney. Hearing on status of diversion is scheduled for 8/31. 

Now that Leach is out of custody, will he shave his full beard and be recognizable and will he get treatment, follow the law or add another arrest?

8/31: Mental diversion granted. Review hearing on diversion on 11/30.

2/13/24: Leach was arrested by EPD today for PC 647 (f) public intoxication.
