Devon Cathey resolves his case on second day of jury trial for a stipulated term of 17 years



I just did a post after trial assignment. I reported on the defense offer at trial assignment. The DA made an offer on 8/28 which Cathey rejected, then more negotiation.

Looks like Devon Cathey finally woke up to the reality that the DA won't keep negotiating and he risks going to prison. Cathey has the best defense attorney, Ms. Andrea Sullivan but he and his record were up against the best Humboldt prosecutor, Deputy District Attorney Whitney Timm. She is doing back to back trials and winning.

Cathey's case resolved today on the second day of trial but before jury selection. He pled to voluntary manslaughter with a special allegation of PC 12022.5 (a) personal use of a firearm in the commission of a felony and an added count of  PC 136.1 intimidating a victim or witness for stipulated state prison sentence of 17 years. Cathey waived his right to appeal and custody credits through today. 

Vonda Cathey, his wife of many names, entered an open plea to Count 2,accessory after the fact. Her attorney is Deputy Conflict Counsel R.J. Leohner. Ms. Timm's motion to remand Carlson was denied. Let's see if she shows up for sentencing. Sentencing for both is on 9/20.



9/20: Devon Cathey sentenced. Vonda Carlson remanded into custody, her sentencing continued to 10/4.




10/4: Vonda Carlson sentenced.
