Pitchess motions filed in Ryan Tanner case

 


Murder suspect Ryan Tanner's preliminary hearing will resume when the next witness arrives. Tanner's preliminary hearing expected to continue next week due to scheduling and court being closed.

Both People and defense filed Pitchess motions. Deputy District Attorney Whitney Timm's Pitchess motion was denied without prejudice by Judge John Feeney. She is going to refile.

The hearing on the two defense motions is scheduled for November 24. This is to give County Counsel time to respond.  Deputy Conflict Counsel Anne Nguyen was in court today.

People have filed an opposition to Mr. Russ Clanton's motions.

A Pitchess motion is a request made by the defense in a California criminal case to access a law enforcement officer's personnel information when the defendant alleges police misconduct. These allegations could excessive force by the officer or issues surrounding the defendant's arrest. The information provided will include prior incidents of use of force, allegations of excessive force, citizen complaints, and information gathered during the officer's pre-employment background investigation. The motion's name comes from the case Pitchess v. Superior Court.
