Juror in Jeff Tsarnas' case brings up Marci Kitchen case

 


After some motions in limine, jury selection has started in Jeff Tsarnas' hit and run jury trial. About an hour into questioning, the initial group of 16 jurors,  right before 11:30, Judge Kelly Neel and the attorneys questioned a female juror. The potential female juror followed the Marci Kitchen case and mentioned that she feels there is a connection to this case. Judge Neel said there was a "lot of media attention on that case."

The potential juror said her heart goes out to Jeff Tsarnas and his family. Deputy District Roger Rees asked the juror, if he proves his case beyond a reasonable doubt, could she put her feelings aside and be an impartial juror. You cannot hear the jurors and in rare instances, if you can, it's inaudible. It seems from Mr. Rees' follow up question, this juror does not feel that the Jeff Tsarnas case is the right one for her. 

Few potential jurors in the initial group of 16 have previous jury experience on more than one trial and at least one as a jury foreperson. Judge Neel talked about different kinds of jury trials and different burden of proof.

Several had family members who were either convicted or arrested and most said they felt their family members were treated fairly by the system. One man only heard about his daughter's experience through her and said based on what she said, he does not believe she was treated fairly. This was in the Bay Area. Another guy said his nephew had a local warrant out. "You want me to tell you where he is?" The same juror said that due to the changes in bail, people like his nephew were out on the streets.
