Alpesh and Magan Natha a no show for their depositions in a case where they are appealing a Labor Commission ruling


Eureka Townhouse Hospitality is appealing a ruling from the State Labor Commission involving a former employee Candice Knight. The amount Eureka Townhouse Hospitality have been ordered to pay is 156,626.91.

Mr. David Nims represents Knight. Ms.  Vanessa Negrete represents Magan Natha and Eureka Townhouse Hospitality. 

Mr. Nims filed for an ex parte application hearing which took place this afternoon.

The ex parte application was granted. "The Motion to Compel Magan and Alpesh Natha’s depositions will be heard next Friday," Mr. Nims told me. "If they show up to their depositions that morning, the motion will be moot. If they no-show (again), then I will be asking for the motion to be granted and sanctions to be issued."

Ex parte is Latin meaning one. The purpose of Ex Parte application is to prove that that one party needs an urgent order because of an emergency situation. The Judge grants the order if you have based on the the affidavit and supporting documents.

An ex parte hearing is requested without the usual notice to the other party and the other party does not have to be present.
