Setting for Maziar Eshghipour's preliminary hearing and motion to file third amended complaint was scheduled for this morning.
The next court date is 8/29 for setting of preliminary hearing, change of plea and arraignment on the third amended complaint.
Instead of the five felony charges and special allegation, this third complaint has three misdemeanors and no special allegations.
The defense had filed a demurrer. That ruling kept getting continued. The third amended complaint can be interpreted as the DA's office conceding to the defense demurrer.
It is very rare that demurrers are granted or won and that has been my observation while covering the Humboldt courts.
Deputy District Attorney Tobias Hasler is the prosecutor for this case. Mr. Greg Rael and Mr. Patrik Griego are representing Esghipour. Mr. Rael was in court today.
