After an eloquent argument presented by Deputy District Attorney Whitney Timm, and statement by Jane Doe's mother in court this morning as well a letter by Jane Doe and concerns raised by the jail, Judge Christopher put a kibosh on J. D. Grow trying to avoid serving jail time.
Ms. Timm said that after J.D. Grow entered his plea, "she got a sense of finality." Now with the defense request for electronic monitoring and request for resentencing, "all of this has retraumatized her."
"She is very upset," said Ms. Timm. Deputy DA Timm reminded Judge Wilson that at the time of sentencing he said while Grow was not getting enough time, it was satisfactory. Ms. Timm said at the hearing when Grow's scheduled jail date was vacated and defense requested resentencing, he failed to mention he had been laid off. Grow used his job as a reason not to serve his sentence in jail. Ms. Timm requested Grow be remanded into custody today.
Modification of J. D. Grow's sentence requested by the defense was denied. New surrender to serve his jail sentence is August 3 at 9 a.m. People's request to remand Grow into custody today was denied by Judge Wilson.
