Case of man charged with criminal threats and vandalism on attorney Russ Clanton's property to proceed to trial

What could have been first known case pre-trial mental health diversion in Humboldt County will now proceed to jury trial.



In September, Judge Timothy Canning said that Michael Black meets prima facie eligibility for diversion.

Today, Judge Canning made the final decision in the case and denied the request for a pre trial mental health diversion; PC 1001.36 (h) for Black.

Judge Canning denied the request because there is no one able to supervise him on diversion. There are no funds allocated to  this in Humboldt county and any local  agency or probation.

Judge Canning specifically declined to make a ruling about Black’s  suitability for the program.

An OR/Bail hearing is scheduled for December 4. Trial confirmation for January 8. Jury trial for January 22.

The District Attorney's office motion to continue the hearing for Michael Black from November 14 to today was granted over the objection of Black's attorney, Ms. Andrea Sullivan.

Deputy District Attorney Whitney Timm is prosecuting the case.
