Jury trial for Andrew Cunningham rescheduled, he will be allowed to have written communication with his sons


Trial confirmation was scheduled for alleged molestor Andrew Cunningham on November 26. Jury trial scheduled for December 10 was vacated.



The case is being prosecuted by Deputy District Attorney Carolyn Schaffer. Cunningham is represented by Mr. Michael Robinson.

"Ms. Schaffer and I have had ongoing discussions regarding a realistic and pragmatic trial date due to both our schedules," said Mr. Robinson.

The date they agreed to was February 4,, 2019. Ms. Schaffer told Judge Timothy Canning that the People agree to the motion to continue. The motion was granted.

A pre-trial date was scheduled for January 23 at 8:30 to make sure defense has completed "ongoing investigation" and to address any other issues that may impact the trial date.

There is a possibility of resolution. Both sides stipulated to a change in the no contact restraining order that pertains to Cunningham's sons.

The People will submit an order after today's hearing that will allow Cunningham to have written communication with his sons and they can write back to him  if they wish.

Charges are slightly different  in the complaint filed for jury trial.


Victim witness  and North Coast Rape Crisis Team representatives were in court today. No other media was in court.
