HUMMAP served County with lawsuit against commercial cannabis ordinance citing environmental impact

County Clerk was served with a copy and County Counsel has it. The clerk's office at 4th and I confirmed the February 26 filing.

The lawsuit basically alleges violations of CEQA and the compensation sought is unlimited.

Humboldt County Counsel Jeffrey Blanck still had the same response, no comment at this time.

Some of the photos I am most grateful for were taken by Mark McKenna right after the press conference on Jan 1, 2014 when immediately I started praying the rosary at the request of fellow parishioners who joined in, Mark was very respectful as he captured our genuine grief, anguish, shock. Others were taken over the next few days by Nick Adams for TS. These have been comforting to look at for the ast two years.

Sounds pleasant? It's not a conference center, not a, retreat, it's the new San Mateo County jail.

Photos of broken window, drain pipe, apparent blood stains on items and bloodied bruised face and body of Fr. Freed admitted into evidence

Former EPD Detective Todd Wilcox now working as reserve deputy for HCSO has been testifying all morning.

Besides court staff, I was the only one in Courtroom 1. No other media present. No one in the audience, a parishioner came in just before the mid morning break.

Starting with photos of the broken window to photos leading to the rooms upstairs in the rectory where Fr. Eric Freed's body was found, broken glass shards, paint chips, pipe rust chips, metal pipes, empty alcohol bottles, and what seem to be blood stains and smears on carpet, in the bathroom as
well in various rooms upstairs to the actual a blood soaked shirt removed from Fr. Eric's body was admitted into evidence drawing the timeline and path of the person who allegedly killed and tortured Fr. Eric Freed.

Mid morning we are up to 68 exhibits for the People ; by noon it was 120 and in the afternoon 121.

EPD's John Gordon testified briefly this afternoon about collection of another Pilsner glass from one of the cabinets in the room where Fr. Freed's body was found. He said this glass was a part of  a set, with at least three other glasses. This was exhibit #121.

He also took possession of fingernail clippings and scrapings under Fr. Freed's nails which  Dr. Super provided to him during the autopsy for Fr. Freed. These were placed in a piece of paper then into an envelope and that was put into a larger envelope, taped and sealed and put in a metal box. It was then sent to Kay Belschner, Eureka DOJ senior criminalist, who did her analysis and sent them to Amy Rojas.

Individual jurors will be questioned this afternoon and for the rest of the week. Due to the sensitive nature of the questioning and case, this will occur in a closed courtroom.

Bullock dressed today in a pinstripe dark blue shirt and black pants sat silently, showing no emotion. He was given paper and a pencil and it remained blank all day.

When his attorney, Mr. Kaleb Cockrum talks to him, sometimes he will respond briefly with a nod or a word. Today, as court resumed after mid morning, he had a slight smile in response to what Mr. Cockrum said.

$350,000 bail enhancement granted by Judge for alleged sexual assault suspect Justin Patrick

On Tuesday March 1, 2016, at 8:51pm, Deputies from the Humboldt County Sheriff's Office located attempted sexual assault suspect Justin Farris Patrick in the lobby of the Arcata-Eureka Airport in McKinleyville.  Patrick was interviewed by APD investigators regarding the attempted sexual assault in the 1900 block of H Street in Arcata, and was subsequently arrested and booked into the Humboldt County Correctional Facility by APD on the following charges:

·         PC 664/261(a)(2): Attempted Rape.

·         PC 236: False Imprisonment.

·         PC 243.4(e)(1): Sexual Battery.

·         PC 240/242: Assault & Battery.

A bail enhancement in the amount of $350,000.00 was sought by investigators and was granted by a judge of the Humboldt County Superior Court.

APD has Justin Patrick in custody

Arcata Police have arrested Justin F. Patrick, who allegedly sexually assaulted an HSU student and assaulted an HSU staff member today. His arrest followed an intense search by both Arcata Police and University Police.

On Tuesday, March 1, 2016, at about 10:44 p.m., Humboldt County Sheriff’s Deputies responded to the McKinleyville Airport for a report of wanted person Justin Patrick sleeping on the premises. Patrick was wanted by the Arcata Police Department for assault and battery, touching a person intimately against their will, and false imprisonment.

Deputies responded to the airport and approached the sleeping Patrick. Patrick awoke from his slumber after deputies called him by name. Patrick was handcuffed and placed in the patrol vehicle. At the request of the Arcata Police Department, deputies took Patrick to APD Headquarters. Patrick was released to the officers for questioning.

APD looking for Justin Farris as a suspect in an alleged attempted sexual assault

On Tuesday March 1, 2016, at 4:50 pm, the Arcata Police Department responded to an apartment complex in the 1900 block of H Street on the report of an attempted sexual assault that had just occurred in a laundry room.  The survivor received minor facial injuries as a result of the attack and the suspect was last seen fleeing southbound between buildings on H Street.

The suspect was identified as Justin Farris Patrick DOB: 08/19/1990, from a Humboldt State University Caution poster that had recently been provided to students due to Patrick's arrest on campus for lewd acts.  Patrick is believed to be transient in the Arcata area.

Patrick is described as a black male adult, 25 years old, 6'0", 200 lbs with brown hair and brown eyes.  Patrick was last seen wearing a black knit cap, black long sleeved shirt under a white t-shirt and dark colored jeans.  Patrick was also carrying an unknown color jacket and a clear zip lock back with miscellaneous items.

The Arcata Police Department is working with the Humboldt State University Police Department to locate and apprehend Patrick.   Patrick is currently wanted on the following charges:

·         PC 243.4(e)(1): Sexual Battery

·         PC 236: False Imprisonment.

·         PC 240/242: Assault & Battery

Just in, Justin Patrick out of custody again, since yesterday, allegedly assaults a HSU staff member

An HSU email states :

University Police are renewing their warning to the HSU community about Justin Farris Patrick. Patrick most recently was on campus today where he allegedly assaulted a staff member. Patrick was previously arrested on Friday, Feb. 26 for lewd public acts.

Patrick had been ordered to stay away from campus for a minimum of 7 days, but appears to have defied that.

University Police are advising the HSU community to be extremely cautious as the search continues for Justin Farris Patrick.

Patrick has allegedly assaulted two people today. Late this afternoon, a man matching his description assaulted a female HSU student near campus on the 1900 block of H Street. Earlier in the day, he allegedly assaulted a staff member on campus.

Both the University Police Department and the Arcata Police Department have responded to today’s incidents.

Don't judge a book by its cover or in this case, by headlines.

Press releases don't tell the whole story and a criminal record is not the whole picture.

Covering the courts has  been a journey.

If you read my blog regularly, there have been posts about people who turned their life around. Majority of the people give me positive feedback. Even some whose cases I have covered. There are a few people who I write about that are upset at first, but then some of them have either reached out to me or I have reached out to them and what may be an adverserial interaction at first becomes a friendship among strangers.

Two cases that I have written about previously have changed their act and are working hard for another chance. James Cunha and Rebecca Hamline  are class acts.

They would have no reason to get to know me or reach out to me but they did. We talked today and I am glad. I would particularly like to thank them for their kindness regarding Fr. Eric and their support.

I wish them the very best and hope to write about their future successes.

Every one deserves a second chance, or third. Thanks Rebecca and James for the spirit of forgiveness and giving me that chance to get to know you.

Keys with a HSU stamp, insurance paperwork and ID cards with photos and name of Fr. Freed recovered from the Eel river by Deputy who had to wear a wetsuit to reach access

At 3 p.m. this afternoon, HCSO Deputy Braden Brawner testified for the People, in an 402 hearing regarding admissibility of evidence.

These evidence hearings and jury selection has gone very smoothly so far, with both Deputy District Andrew Isaac and Gary Lee Bullock's attorney, Mr. Kaleb Cockrum keeping things succinct, focused and orderly.

Deputy Brawner is assigned to boating detail which includes patrolling waterways and oceans and recovery of evidence items from the water.

On January 7, 2014, Deputy Brawner was asked to recover items found by a couple in the Eel river near the Miranda bridge. The deputy indicated the location on a Google Earth map.

"The items were deeper than they appeared from the above," said Deputy Brawner. On January 7, he was only able to retrieve an ID card. The next day, he went back in a wetsuit to recover the paperwork, keys and other items.

After recovering the items and securing them into evidence, he took the items to Eureka Police Department and gave them to Detective Todd Wilcox.

In an envelope, which is was admitted as Exhibit 18, there were three keys. Deputy Brawner said that the one with the HSU stamp is one he specifically remembers noticing during retrieval.

These keys were put in a plastic bag and labelled Exhibit A and then put back in the envelope they were originally sealed in; same was done with Exhibit 19 which were ID cards.

Deputy Brawner said that of those ID cards, the ones that stood out to him at that time had Fr. Freed's name on them and some had his photo and there was a Bear River Casino card.

An insurance document was the last exhibit admitted today.

These items were all "fairly close together," said Deputy Brawner. "In a circle of approximately 15 feet in diameter."

Tomorrow Detective Wilcox will testify.

Today is the first time that Mr. Cockrum leaned over in between testimon  being given and whispered something to Bullock, who shook his head and said "no."

Former Hoopa softball coach William Jarnaghan jury trial confirmed, resolution still a possibility?

Trial confirmation was scheduled for William Jarnaghan at 2 p.m. this afternoon in Courtroom 5.

Dates were confirmed this afternoon but the defense request for a motion to continue today's hearing for a week was denied by Judge Joyce Hinrichs.

Judge Hinrichs told Mr. Greg Rael, who was specially appearing for Mr. Neal Sanders who is Jarnaghan's attorney,  that a written motion to continue or a hearing needed to be scheduled if there is a resolution before trial. Written notice allows for notification to the victim per Marcy's law.

Deputy District Brie Bennett is prosecuting the case.

Resolution before jury trial may happen in case for former Hoopa softball coach charged with alleged sexual charges involving former student

This afternoon, trial setting for former Hoopa softball coach, William Jarnaghan, was scheduled in Courtroom 5.

Deputy District Attorney Brie Bennett is prosecuting the case. Mr. Neal Sanders is representing Jarnaghan. DDA Jackie Pizzo subbed in for her colleague this afternoon.

Mr.  Sanders said, "We are trying to see if we can get a resolution on the case. We were hoping for that today. The family needs to decide what kind of disposition they want."

Since it is a time waived case, jury trial was set for February 16 at 8:30, Trial confirmation for February 2 at 2 p.m and pre trial on December 15 at 2 p.m.

DDA Jackie Pizzo said, "My only concern about setting it in February is that I haven't spoken with the victims."

Judge Hinrichs said that while she realizes that under Marcy's law, victims are entitled to speedy resolution, this is a time waived case and "we are trying to set realistic time frames" of when cases will proceed.

William Jarnaghan enters not guilty pleas at arraignment for alleged sexual charges against minor victim

Former Hoopa High school softball coach William Jarnaghan was arraigned on information this afternoon in Courtroom 2. Exact same charges as preliminary hearing. All counts are against a female victim under 18 years old. Counts 1,2 and 3 are felonies. Sexual penetration/Foreign object PC 289 (h). Counts 4,5 and 6 are misdemeanors. Annoying/Molest a child under 18 years. PC 647.6 (a)(1).

If convicted, Jarnaghan will have to register as a sex offender.
Jarnaghan entered not guilty pleas.

Deputy District Attorney Brie Bennett is prosecuting the case. Mr. Neal Sanders is representing Jarnaghan.

Trial setting is 10/29 at 2 p.m. in Courtroom 5.

Remember Brett Hansen, most recently in the crime headlines for an EPD standoff?

He had an intervention scheduled, pleaded guilty in 2 cases, in one cases had certain counts dismissed with a Harvey waiver and had a two probation revocation cases resolved in a plea deal.

Details of plea and sentencing date for DDA David Christensen:

"He pled guilty to Evading the Police w/Reckless Driving and Possession of a Firearm (both felonies); a misdemeanor assault in the jail; and admitted his misdemeanor violations of probation.  We agreed to recommend felony supervised probation, drug treatment, and a protective order for the alleged victims.

The sentencing has been scheduled for March 24^th @ 4:00."

$10,000 bail set in new case against Brett Hansen for alleged assault and battery while in custody

Bret Hansen arraigned on new misdemeanor charges of assault and battery  this afternoon. Hansen is in custody and this allegedly happened in jail. Alleged victim is David Eric Hipes.

$10,000 bail set for this case. January 20 s Hansen has a preliminary hearing scheduled. Jury trial is February 8 at 8:30.

He was to be arraigned in Courtroom 5 but Judge Dale Reiholtsen who is filling in for Judge Hinrichs was disqualified so the case was sent over toJudge Miles in Courtroom 2 .

Conflict Counsel could not represent Hansen anymore because they are representing a co-defendant. Public Defender could not either. So, private attorney David Celli from Russ Clanton's law office was appointed for him and Alternate Conflict Counsel was appointed for his codefendant.

$60,000 bail set for Brett Hansen who was arrested New Year's day in EPD standoff

He was arraigned today for the October 20, 2015 incident and the New Year's incident and three petitions to revoke probation in previous cases.

In the October 20, 2015 incident, Hansen is charged with three counts: evading a police officer, obstructing/delaying a police officer and driving with a suspended license.

In the New Year's incident, there are 6 counts: second degree robbery, unlawfully taking/driving a vehicle, felon in possession of a firearm, manufacturing a short barreled gun, obstructing/delaying a police officer and driving with a suspended license.

There is an OR/Bail hearing scheduled for January 7; and preliminary hearing on January 20 at 8:30 a.m.

Brett Hansen (below) and a female suspect yet to be identified. This just confirmed by a source who was at the scene.

On October 20, 2015 according to CHP watch and other media reports, Hansen allegedly led police on a high speed chase, then crashing his car on Kelly Avenue in McKinleyville and fleeing the scene.

Hansen has a lengthy rap sheet going back to 2000, been arrested at least 15 times.

According to EPD's Captain Steve Watson's twitter account, Hansen will face an additional charge of a felon in possession of a firearm. Under California law, this is a wobbler and can be charged as a misdemeanor or felony. Criminal history is one factor taken into consideration. The car Hansen allegedly stole was an Acura.

North Coast News just reported the 23 year old as Halli Pole.

On facebook, there is a woman with that name and the same age, 23, as reported in several media accounts, according to her facebook page, she is from Hoopa. And according to facebook, in a relationship with Canyon Hodge.

EPD Press Release:

On 2/24/13, at about 4:19 PM, officers with the Eureka Police Department (EPD) were dispatched to the 2800 block of ‘F’ Street on the report of a suspicious male in a vehicle. A witness reported a male subject had been sitting inside a parked vehicle for the past half hour. The male was reported to be “making strange movements” and he appeared to be falling asleep or passing out. Per the witness, a roll of cash was also visible in his lap.

An officer arrived on scene a short time later and approached the male, who was seated in the driver’s seat of a 4-door Nissan Maxima parked on the street in front of a business. The officer observed that the male, later identified as Canyon Hodge (no middle name), was slumped over and appeared to be asleep. The officer also saw what appeared to be a large baggy of tar heroin in Hodge’s lap and a big roll of cash next to him on the passenger seat. The officer recognized Hodge and knew he had a felony warrant for his arrest.

The officer roused Hodge with some difficulty and took him into custody on his warrant. During a subsequent search of Hodge and his vehicle, the officer located approximately 43 grams of tar heroin (1 ½ ounces), 3 1/2 grams of crystal methamphetamine (1/8th ounce), a small quantity of processed marijuana, a digital gram scale, written records indicating recent heroin sales activity, $3,042.00 cash, and drug use paraphernalia (hence “Mr. Sleepy,” who appeared to be heavily under the influence of heroin and nodding off due to his partaking liberally of his own product).

The cash was seized as suspected illicit drug sales proceeds to be turned over to the Humboldt County Drug Task Force for future asset forfeiture proceedings.

In addition to his warrant (alleging possession of a controlled substance), Hodge was arrested for possession and transportation of a controlled substance for sale, possession of drug paraphernalia, and parole violation. He was transported to the Humboldt County Correctional facility for booking. Hodge’s vehicle was also towed from the scene.

After the evidentiary hearing this morning in the Gary Lee Bullock case, Judge John Feeney and the attorneys went over hardship questionnaires for 75 new prospective jurors. Yesterday, 72 new prospective jurors filled out the hardship questionnaire. Thse not excused from the 72 yesterday were asked to fill out long questionnaires.


At 1:30, the Court went through the long questionnaires of potential jurors from February 29. Some were scheduled for individual questioning. Groups of 5 jurors will be questioned individually, starting  tomorrow at 2 p.m. and continuing on Thursday morning. Those not being questioned individually from this first group will be told to call back after 5 p.m. this Friday.

Mr. Kaleb Cockrum , who represents Bullock, wants the cover sheet for the jury questionnaire amended regarding media reports and jurors not talking with each other. Suggested language and a proposed draft will be discussed.

Some jurors were excused after the first questionnaire, including one local member of the Catholic community who knew Fr. Eric Freed well.

One witness for the People will testify at 3 p.m. and that will conclude the evidentiary hearing for today.

Man accused of lewd acts at HSU last Friday, arrested yesterday had just been released after a plea deal on 3 cases on February 24

Justin F. Patrick had just been released after sending 14 days in jail, pleading out three cases; one from January 2016, one from December 2015 and one from November 2015. The December case was dismissed as a part of the plea deal on February 24.

The November 2015 case was a felony  with Count 1 Vandalism of $400 or more. According to the complaint, Patrick "unlawfully and maliciously defaced with grafitti and inscribed material" and damaged/destroyed window at Domino's Pizza in Eureka.

The December 2015 case that was dismissed involved  a misdemeanor: providing false ID to a peace officer.

The January 2016 case was a misdemeanor. Count 1 Obstructing/Resisting arrest and Count 2 providing false ID to a peace officer. He plead out before his preliminary hearing in this case.

Following his release on February 24,  Patrick was arrested on HSU campus on Friday, February 26. Then he was arrested, again, yesterday, February 29.

Patrick was represented by the Public Defender's office on all his cases.

Man warned to stay away from HSU campus for alleged lewd acts arrested again yesterday

Justin F. Patrick, who was arrested last week for alleged lewd acts on HSU campus and warned to stay away was arrested again yesterday by the Humboldt County Sheriff's Office for PC 148 (a), basically obstructing or resisting a peace officer.

University Police are asking the HSU community to be cautious of Justin Farris Patrick. Patrick was arrested on Friday, Feb. 26 for lewd public acts.

Patrick allegedly approached a woman seated at a table on the second floor of the Library, stood over her shoulder touching his genitals through his clothing while continuing to talk to her. His behavior made her feel threatened and he ignored her repeated requests that he leave her alone. Patrick was arrested and transported to the Humboldt County Correctional Facility.

Patrick has been ordered to stay away from campus for a minimum of 7 days.

Jason Arreaga pleads out and is sentenced for second case involving drugs in jail

Jason Arreaga who was acquitted February 23 after his second jury trial for the deaths of Harley Hammers and Angel Tully, had an intervention hearing scheduled for February 29 and a preliminary hearing scheduled for March 7.

This was for a case from 2015 is for Count 1 alleged possession of drugs, marijuana, in jail and Count 2 bringing drugs/alcohol into Penal institution.

At the intervention hearing yesterday, Arreaga plead out and was sentenced.

Deputy District Attorney Roger Rees provided the details if the plea.

Jason Arreaga pled guilty to violating one count of Penal Code section 4573.5 for a stipulated term of 16 months. He received credits for his time served and was ordered released from custody. I have been informed that he was in released last night.

Eureka Police Department's Detective John Luken testified this morning and identified photos on John Bruno's property where allegedly Gary Lee Bullock had concealed Fr. Eric Freed's car behind brush and cut branches.

John Bruno is Bullock's step father. In the preliminary hearing, testimony was given that Bullock showed up on January 1, 2014 with blood on his clothes and asked to take a shower and change clothes.

Detective Luken also identified photos of a blue thermal shirt and black sweatpants and then opened the evidence bags identifying the clothing.

HCSO Investigator Greg Musson testified about routes from Eureka to the Bruno residence in Southern Humboldt.

HCSO Sgt. Jesse Taylor who serves the Southern Humboldt area testified items found by a couple in the Eel river north of the Miranda Bridge which included a briefcase, a bible, paperwork and a card with Fr. Freed's name on it.

Kay Belschner, senior criminalist at the Eureka DOJ office testified about items sent for DNA analysis which included clothing patches cut from Bullock's clothing; swabs from a decorative glass vessel, the bottom of which was broken; cigar retrieved from the kitchen, fingernail clippings from both of Fr. Eric Freed's hands; penile swab from Fr. Freed and a swab from a watch later recovered from the crime

A photo of Fr. Eric lying on the floor next to a table with bruises on his chest, bloodied hands and arms and face covered with blood and contusions was identified.

Man warned to stay away from HSU campus for alleged lewd acts arrested again yesterday

Justin F. Patrick, who was arrested last week for alleged lewd acts on HSU campus and warned to stay away was arrested again yesterday by the Humboldt County Sheriff's Office for PC 148 (a), basically obstructing or resisting a peace officer.
