Preliminary hearing was scheduled to start August 10 and continue on August 11 and 12 for homicide suspects Ian Pease and Travontae Hutson. 

In addition to this homicide case, Pease has two other cases "trailing."

The bailiff told the defense attorneys that Pease and Hutson were red tagged so they had to be seated separately. One at the attorney's table; the other in the jury box.

Ms. Kathleen Bryson represents Pease. Mr. Zachary Curtis  is the attorney for Travontae Hutson. Deputy District Attorney Carolyn Schaffer is the prosecutor for the case. Deputy DA Shelly Small has joined as counsel for the preliminary hearing.

Investigator Henderson is the lead investigator for the DA. Tom Chapman is the defense investigator for Ms. Bryson. Desirae Hadley is the investigator for Mr. Curtis.

Victim is Perry Bailey.

I covered Perry Bailey as a defendant and mentioned this since the initial coverage.  In fact, Ms. Bryson represented Perry Bailey. He fled after a Cruz waiver, lied after bench warrants were issued and was busted for meth.

Perry Bailey has 29 cases in  the Humboldt Superior Court system. Most of them are criminal. The last case filed against him was in 3/20/2020 for revocation of PRCS. It was dismissed on 12/16/2020. This would be after his death in November 2020.

The People's first witness Andrea Claypool Bailey is still on the stand this afternoon. Two of the officers scheduled to testify have to attend an autopsy this afternoon. Ms. Schaffer told Visiting Judge Marjorie Carter that People's witnesses may need tobe called out of order.

The People's first witness Andrea Claypool Bailey is still on the stand this afternoon. Regarding Perry Bailey, she said," We were in a relationship for 11 years and got married in 2018."

In November 2020,  when asked if they were living together, Andrea Bailey said,"technically no."

"I was essentially living out of my car and in motels. Most of the time he was with me but he had another house with another significant other Heather Boak. He would meet her and hang out with her multiple times a day.

On November 15, Andrea Bailey saw Perry Bailey in the morning. Then at 9 p.m. , "he picked me up in a Lincoln MXK model; a black, some people would say dark grey SUV."

Perry Bailey asked Andrea Bailey to meet him at Buhne and Fairfield in her car. Since his license was "not valid", Perry Bailey wanted Andrea Bailey to drive his car.

"There was another female with him. Bri, I don't know her last name," said Andrea Bailey. She drove with Perry Bailey in the passenger seat and Bri seated in the back. They drove around "for a while, then went to Heather's house."

Perry Bailey went inside and the two women stayed in the car. This was"around 9:30/10. Perry was in the house for an hour. He and I had been arguing about his relationship with Bri." This was in front of Bri.

Perry Bailey "had set the alarm on the car" so it would go off if the women tried to get out. Perry Bailey took over driving and they were "driving towards Samoa. He said he would beat me at the stop sign." That did not happen.

"We pulled up in front of Cassidy's trailer," said Andrea Bailey. She had no idea why they were there. From this point on she sometimes used the word truck to refer to the SUV. "He told me,' don't get out of the truck' ; I will be back."

"Perry got out. There was a dark colored car; a sedan parked to the right of the RV. A couple other vehicles behind the RV . Perry walked around the SUV. He stopped next to the dark colored sedan. He was standing next to the front passenger door of the sedan."

"I couldn't make out anything that was said. Something felt off. I just heard voices. It wasn't a positive interaction. He had his leg into the door and he was arguing with whoever was in the vehicle. I opened the truck door but was inside the vehicle." 

She saw a struggle. "Then there was a gunshot and another gunshot. I jumped back in the vehicle. Then there were multiple gunshots. They sounded like firecrackers."

In the court system, her name listed is Andrea Claypool. I wrote the name she stated on the stand. Both Andrea Claypool and Heather Boak have traffic cases and family law cases in the system with Bailey. Andrea Clapool also has a nolo plea and conviction in 2011; on a traffic charge and obstructing/resisting an officer. Another charge of evading a peace officer was dismissed.









The preliminary hearing finally concluded on August 13. Both defendants were held to answer as charged. Arraignment on information is on August 31.

Charges:



8/31: Pease and Hutson were arraigned. Trial setting date scheduled.










10/6: Trial setting was continued by stipulation to 10/28

10/28: Pre trial 4/12/22; trial confirmation 5/9/22 and jury trial on 5/31/22.
