Alleged rapist Darrius Upshaw trial had ended early on May 25 so defense investigator Cisco Lassiter could talk with witness William Blohm.
Mr. Russ Clanton wasted the entire morning on May 26, again before testimony. More time wasted during his cross examination of Blohm. He was not able to impeach Blohm or Julio Armenta Munoz or Raul Barbosa but we did sit through irrelevant questions on how Snapchat works and if Chi Phi has a social media page. Heard him in the morning but in the afternoon, once again, he did not turn his mic on and walked all over the courtroom. Mr. Clanton reserved the right to make an opening statement later.
Due to all the time wasted, jury trial that should have ended yesterday continues into next week on Tuesday, Wednesday and possibly Thursday.
Deputy District Attorney Carolyn Schaffer made a brief opening statement.
Counts 1 and 2 pertain to John Doe #1 and occurred after the wine/cheese party. John Doe#1 became intoxicated, vomited on himself, fell asleep and "woke up to the defendant orally copulating him." Upshaw's mouth was on John Doe #1's penis. John Doe's pants were pulled down. John Doe froze. "Defendant orally copulated him, defendant was masturbating and then Upshaw ejaculated on his face."
Counts 3,4, 5 and 6 pertain to John Doe #2. He was "in and out of consciousness. Defendant had removed John Doe #2 from his vomit, removed his clothing. John Doe #2 woke up later to the defendant orally copulating him. John Doe ejaculated and fell asleep. "
John Doe received text messages from Upshaw later that his clothes were in the dryer. "You were face down until I dragged you to the edge," was a text message John Doe #2 received from Upshaw.
After another event, John Doe #2 woke up and his pants were undone and defendant orally copulated him. Later, John Doe received a text message from Upshaw stating John Doe owed him a car wash because he threw up in his car.
When Upshaw was arrested, his phone was booked into evidence. Ms. Schaffer described the chain of custody and how it ended up at NC3TF.
Text messages were downloaded which indicate Upshaw solicited other individuals and had a preference for certain text acts. Mr. Clanton objected, Ms. Schaffer presented her argument. Judge Neel deferred her ruling on whether those messages will be allowed.
Blohm testified about taking a video on May 18. John Doe was slurring his words, stumbling, drinking quite a bit. John Doe passed out. He had fallen asleep with his shoes on. "If you fall asleep with your shoes on, people draw on your face. So I drew on his face. Darrius took his shoes off. "
Blohm used a sharpie. Took video.
Blohm said everyone knew Upshaw was gay. "Everyone was okay with it." There was no homophobia.
From testimony so far and the information from Upshaw's military case, it seems like Upshaw likes to give rides and offer help and picks up extremely drunk men and after they fall asleep, they all wake up to him giving them a blow job.
