Opening statements were scheduled in alleged rapist and former HSU student Darrius Upshaw's court trial. John Doe #1 and John Doe #2 were expected to testify. Instead there was a delay after motions in limine and an additional witness.
Deputy District Attorney Carolyn Schaffer is the prosecutor for this case. Mr. Russ Clanton is Upshaw's attorney.
Mr. Clanton did not bother to speak into the mic. So, I saw his theatrics and over the top gestures which are wasted since there is no jury watching. Judge Kelly Neel's and Ms. Schaffer's responses gave me an idea of what he said.
Upshaw who has refused to resolve this case was not happy with another continuance caused by his attorney.
1108 evidence is being allowed but the witness K.M. will not be allowed to testify remotely.
After Julio Armenta Munoz's testimony yesterday, DA Investigator Ryan Hill followed up and located the person with the video of John Doe. This was around 5:30 last evening. That person is William Blohm. "John Doe #1's face is covered with a marker and he had fallen asleep with his shoes on," said Ms. Schaffer.
Investigator Hill received a copy of the video, a screenshot of John Doe and he recorded a statement from Blohm. Ms. Schaffer learned about ithe video, statement and around 8:30 and sent it to Mr. Clanton.
Mr. Clanton wants his investigator Cisco Lassiter to investigate and talk to Blohm. The DA's office is assisting in making that happen today. Blohm has graduated and is leaving the area on Sunday.
Mr. Clanton wants this information before cross examining John Doe #1.
There was stipulation regarding NC3F and someone named Brett.
