Kevin Carns wants to know if he will can be placed on probation before accepting a plea deal


Preliminary hearing for kidnapping and assault suspect Kevin Carns was scheduled for today was vacated. Potential change of plea is scheduled for December 3.

Ms. Christina Allbright is Carn's attorney. Deputy District Attorney Luke Bernthal appeared on the case for the People.

Ms. Allbright asked Judge Kaleb Cockrum to refer Carn's case for a pre sentence report for a potential plea. This is to see if Probation would consider Carns as an appropriate candidate for probation. Carns wants to know this before he decides to accept a plea.

An expert evaluation by the defense was provided to the People as part of the ongoing discussions to resolve the case.

The plea offer is to plead to PC 220 (a) (1), Count 1 and Count 3, PC 236.
