Emergency pass for Gearold Sotolongo denied due several concerns, including "not behaving in custody"

 


Murder suspect Gearold Sotolongo's . Deputy Public Defender Ben McLaughlin appeared in court for Deputy Public Defender Wade Orbelian who is Sotolongo's attorney.

Sotolongo was dressed in a red jumpsuit and shackled.That means he is in admin segregation. 

The request was for a relative Sotolongo "is close to who has a grave illness."

Deputy District Attorney Roger Rees said the People oppose Sotolongo's release. He referred to the way Sotolongo was dressed and mentioned the misdemeanor case Sotolongo picked up in custody for destroying jail property. "Mr. Sotolongo is not behaving in custody."  He mentioned that Sotolongo is charged with first degree murder with premeditation.

County Counsel filed an opposition on behalf of the jail. Captain Duane Christian appeared on behalf of the jail. He said that he did not have anything to add to Lt. Jason Benge's declaration. Captain Christian reiterated Sotolongo's ongoing behavior issues and the concern that when someone returns to the jail, there is the possibility of "reintroduction of contraband."

Judge Lawrence Killoran denied the request.
