“There was no way they were going to win this case," juror gives kudos to Deputy Public Defender Rosemary Deck

“There was no way they were going to win this case,” said a juror referring to the District Attorney’s Office after the verdict came down on Friday.

Deputy Public Defender Rosemary Deck represented the defendant who said, “Justice was served!” after he learned that the jury found him not guilty.

The case was brought by the DA’s office and prosecuted by newly minted Deputy District Attorney Jessica Acosta.

The prosecution alleged that the defendant had been driving under the influence of alcohol, yet nobody witnessed any bad driving. The issue arose when the defendant knocked over a stationary dirt bike, which somebody had left in the defendant’s parking spot.

An argument ensued, and the defendant went inside his own apartment for quite some time before police responded to the incident. By the time police finally arrived, the defendant had consumed several beers in his home. When he spoke with the officers, they jumped to the conclusion that he had been drinking before driving.

Deputy Public Defender Deck argued that the 20-30 minutes that the defendant was in his apartment alone after the incident was enough reasonable doubt to acquit. The jury, it seems, agreed.
