During his cross examination of HCSO Investigator Mark Peterson today, Andrew Cunningham's attorney, Mr. Michael Robinson asked Investigator Peterson whether he was aware if Jane Doe #3's grandfather was a 290 registrant.
Investigator Peterson responded that Jane Doe had more than one grandfather. Mr. Robinson asked if Investigator Peterson was aware if any of Jane Doe #3's family members were 290 registrants.
Investigator Peterson said no.
Mr. Robinson followed up by specifically asking about Fred Simpson.
PC 290 refers to California sex offender registration law. Stephen Simpson is the father of Jane Doe #1, Jane Doe #2 and Jane Doe #3.
A quick search on citydata.com about sex offenders in Eureka and then Megan's law revealed this information.
Fred Simpson was convicted PC 288 ( a) (c), oral copulation with a minor. I verified to see if the Fred Simpson mentioned in court and the name and address listed on Megan's Law for Frederick Simpson was the same person.
Counts 1, 2, 3 and 4 in the Andrew Cunningham case are also PC 288 charges. Mr. Robinson's point during cross examination about a convicted sex offender having access to three of the alleged victims may not have had an impact on the preliminary but in a jury trial, it can be used to create reasonable doubt.
Investigator Peterson relied on a lot of information from Stephen Simpson and Tiffany Wright. The same adults who neglected to inform him of Fred Simpson's conviction.
Like I said yesterday, I feel sorry for the alleged victims.
Certain adults in the alleged victims' lives and unrelated trolls need to stop venting frustration and misdirected anger at me for reporting facts an start focusing on their own actions. Their drama isn't helping the alleged victims.
