Verdict in 24 hours for arson and assault case in Manila encampment
Guilty on both counts. Sentencing is on December 14 at 8:30. According to a press release sent out on Friday, "Domenico could serve 9 years for these two felonies."
Domenico was charged with Count 1 Arson of an inhabited structure and assault with a deadly weapon other than a firearm. Alleged victim Thomas Uber.
The jury started deliberating Anthony Domenico's fate yesterday at 3 p.m. This morning they were back at 9 a.m. They asked for read back of testimony. Shortly before 2:25, they finished with read back, then were watching the KIEM video. At 3:30, the court reporter walked into Coutroom 1, followed by attorneys.
Deputy District Attorney Trent Timm was in training. Deputy DA Steward was present in court today for the People.
After the jury left the courtroom, Mr. Reavis put his hand on Domenico's back and said something to him. Domenico just sat there as the verdict was read.

Good work! It's never easy when the victim is ...unsympathetic, but people with issues are often victimized, because they have issues.
ReplyDeleteGood to hear the jury saw through all the smoke and mirrors Mr.Reavis threw at them with his cross examination of Mr. Uber.
ReplyDeleteI also wonder if Reavis' conduct worked against the defendant...the jury thinking that if attacking the injured party so strongly meant he had no real defense.
I served on a civil jury one time and the plaintiff's attorney (we found out later he was handling four or five other cases for the same man, all personal injury) exaggerated everything so much he undermined his own case ("there's no other possible cause for this injury") so it was a hung jury. I would have found the defendant not guilty on the basis of evidence, but seeing the plaintiff's attorney's reaction was icing on the cake.
All I will say to your response Gabrielle is that you are insightful re both the cross examination and Mr. Reavis' digs towards Mr. Timm in his closing arguments. All but one juror stayed to talk to the attorneys.
