Chad Smith, charged with the molestation of his own step daughter and her friend, has a jury trial scheduled for December 4.
This morning, Deputy Public Defender, Joann Carter appeared with Smith. She stated that Smith wants a continuance and a hearing on a Marsden motion.
Judge Dale Reinholtsen will hold that hearing in a closed courtroom at 3 p.m. Mardsen hearings are confidential. Next court date is trial assignment on December 1.
He was represented by Deputy Public Defender Jennifer Dixon, who left to go to private practice. Then, he was represented at the last three hearings by former Public Defender David Marcus, who resigned last week.
Deputy District Attorney Stacey Eads is prosecuting the case. A 995 motion to dismiss charges is scheduled for December 5.

He's stalling, perhaps while supporters within his family work on the victims. He's definitely stalling, and trying to get the victims to back out is a standard tactic in intra-family cases.

Well, here we go again. Granted he’s had a few changes in attorneys but it’s interesting that the 995 has been scheduled for awhile, and was scheduled for the day AFTER the Jury Trial was to have begun. Fun and games with the judicial system and most certainly with the victims in this case. As long as he’s having a grand time in the HC Jail and not out and manipulating the victims, that’s cool.
