Smith is charged with sexually abusing his own step daughter and her friend, both minors.
A 995 motion to dismiss charge(s) is scheduled for December 5. I thought it was a computer entry error so I checked with court administration. It is not an error.
Ms. Jennifer Dixon, who was representing Smith left the office. At the last hearing, Public Defender David Marcus appeared on the case. Tomorrow should tell whether Mr. Marcus or another Deputy Public Defender will be representing Smith.

anyone want to make a no-value bet on whether PD Marcus will actually appear in court or if he sends a DPD? When did Jennifer Dixon leave? Hope she found a better job.
ReplyDeleteHummmm. I’m not an attorney but even I can see a problem with this. Maybe there is a plan to vacate that date because the new attorney needs to get up to speed, never planning to get the jury in on the 4th? I say go ahead and postpone but keep his ugly ass in custody. Keep us posted,
