Uber had never heard the 911 call or read a transcript of the 911 call that he was getting hammered on during cross examination

Cross examination of Thomas Uber started Thursday afternoon and it lasted almost two hours. .

The cross examination by Deputy Conflict Counsel Marek Reavis was brutal and as it progressed, Uber reacted and got angrier and angrier until he had a complete breakdown.



Uber would give an answer. Mr. Reavis would ask the same question again or a follow up and Uber would try and answer again. Mr. Reavis would keep at it, over and over until it would get Uber frustrated. Mr. Timm would object that counsel was badgering the witness, that objection was overruled.

Uber said he could not recall what he said to 911. He said he was panicked at that time.

Mr. Reavis wouldn't let it go.

"Did you tell 911 Tony shot you?, " asked Mr. Reavis.

"I did say I thought I was shot, " said Uber.

This went on and on until Uber said, "I would probably say anything to 911 to get the cops out there."

Then Mr. Reavis followed up with, "Did you lie when you said you got hit on the head? "

"There was blood on my head, : said Uber. "What are you trying to say? There are 911 calls about Tony theatening to burn my place down. Go ahead pull those tapes!"

"Reavis asked Uber if he recalled saying  in the 911 call that there were 4 guys and that two guys beat him up. Again there was back and forth, until Mr. Reavis reading from a transcript, which he never showed Uber, said, "So that was a lie?"

Uber, "yes."

Uber would go off on tangents at time, those answers would be stricken as non-responsive. It was clear he did not understand certain words like duress well and he was starting to crack under the pressure.

He said others in the camp were ripping him off, taking items like his tools.

At one point, Mr. Reavis asked, "Do you have anger issues?"

"Not really, I get mad but I calm down real fast," said Uber.

Mr. Reavis asked Uber if he disliked "Tony"

"I wanted him to leave me alone," Uber said to Mr. Reavis.

Mr. Reavis asked Uber why he did not share certain details with law enforcement that he shared during his testimony in court.

"They never do anything. Why tell the Sheriff's Department the same thing over and over again?, " responded Uner.

At one point, Uber said to Mr. Reavis, "You are trying to get me angry". Other times frustrated that his answer was never good enough, he said, "Just tell me what you want me to say. I don't want to get in trouble."

Uber claimed that he had told HCSO about ongoing problems with Domenico and threats by Domenico that he would burn Uber's home.

The cross examination ended with Uber telling Reavis.

"I was going through hell. I don't know how to get this through to you. I don't want to answer no more. I want to leave."

Uber asked Judge John Feeney if he could leave. Judge Feeney said no.

The cross examination on Tuesday resumed with Deputy Conflict Marek Reavis not being so aggressive and Uber calmer but then it was a repeat of Thursday's cross examination and another hour of watching Mr. Reavis bait and hammer Uber repeatedly.

In his re-direct of Uber, Deputy District Timm asked Uber if he had read a transcript or heard the 911 call that Deputy Conflict Counsel was questioning him about and Uber said no.
