Will Uber's meltdown hurt him? Or be mitigated by Domenico's lies?

Thursday ended with Deputy Conflict Counsel Marek Reavis being able to push Thomas Uber's buttons. On Tuesday, will Uber be able to stay calmer?

Mr. Reavis can bring up discrepancies about Uber's testimony but is he prepared for the same scrutiny of Anthony Domenico?

While a defendant does not have to testify, Domenico's lies can be exposed through other witness testimony and his own words.

Domenico lied the very day he was arrested for alleged arson and asaulting Uber. He spoke to media and blamed Uber for burning down his own home, then said another thing off camera to KIEM's Monica Petruzelli.

After Deputy District Attorney Trent Timm asked Arcata Fire Department Battalion Chief Sean Campbell about his hypothetical, Mr. Reavis during cross said, "Have you ever heard of false confessions?"

If it was a false confession, why did Domenico ask Ms. Petruzelli, "Camera off? Off record?"

Uber has been out for 3-4 months, in a camp he does not feel safe. Uber claims the rest of the people are Domenico's friends. Uber's only home was burned down.

Domenico had "three hots and a cot" since his arrest. Uber did not get to come to court, rested and sleeping well, dressed in a suit and new glasses at taxpayer's expense.

Testimony during the preliminary and the jury trial disputes some of Mr. Reavis' cross of Uber.

The original dispatch call was for assault. Battalion Chief Sean Campbell testified on Thursday that the original call was for medical for assault.

Uber did refer to a previous assault on August 16.

Domenicio told HCSO Deputy Chanler Bronson that he lived at the encampment for three years.  Uber said Domenico lived there for the past 3-4 months.

It is Mr. Reavis' job to do the best for his client but that aggressive badgering of a witness has backfired for him and his client in the past.

Uber isn't the only witness that has had some inconsistencies in his testimony. People often recall different things between the original incident and jury trial. Will Uber's meltdown be perceived by the jury as a homeless man reacting to years of not being listened to and feeling he is not believed when he speaks up? Or will some of Uber's admissions on the stand Thursday hurt him? Time will tell.

One fact remains unchanged. Domenico lied on camera; confessed off camera and it is on tape, in his own voice.
