Jail call: "On August 20 and 21, defendant and Ms. Murray discuss her plan to say it was me (Murray) so you (defendant) can get out and that Ms. Murray thought defendant would be let out and that she even has an alibi for him."

Horacio Miranda aka "Lil Creeper" wants to withdraw his plea.  Oral arguments  took place this morning. Judge Dale Reinholtsen will issue a written ruling.
Defense attorney Michael Acosta filed a declaration in support of the motion to withdraw plea this morning.

The District Attorney had already filed three declarations; one by Deputy District Attorney Luke Bernthal, one by Deputy District Attorney Roger Rees and one by DA Investigator Marvin Kirkpatrick.

I have a copy of those declarations.

In Deputy DA Bernthal's declaration, a jail call between Miranda and Amiya Murray.

The declaration states: "On August 20 and 21, defendant and Ms. Murray discuss her plan to say it was me (Murray) so you (defendant) can get out and that Ms. Murray thought defendant would be let out and that she even has an alibi for him."

  1. Hi John,

I appreciate the work you do, thank you very much! That said, I think you assume your regular readers know a lot more than they actually do about the goings on at the courthouse and this story is a case in point. I have no idea what this is all about, even after reading it several times and clicking on the link.

I think because you're so immersed in all of the happenings you might be forgetting sometimes to provide enough context for your readers to understand what you're posting about. BTW, this is meant as constructive criticism and not meant to be a put down.

    1. Hi anon. Thanks for the appreciation. As for your comment, while you may have meant it as constructive criticism, I have received the exact same comment once or twice before. It's very passive aggressive. I am not here to make everyone happy nor will I. There is not just the link to the article, there is a link to previous coverage in this case and other links to this case.I provide more details and a lot of information on court cases. You seem to be the only one with this exact issue. It is not a question of my being immersed or not providing context, it is an issue of lazy readers who want me to put in extra work instead of them or people requiring more assistance in understanding obvious information. I dont see you criticizing other court coverage/coverage where media outlets cover just a random hearing here or there and put together sloppy articles. While I have ads,I dont rip people off by charging exhorbitant amounts, so it barely pays for my time on the blog and dealing with the bs from needy people and trolls. I have provided this service, this blog for a long time. Court reporting is not easy to do for an extended period. It is funny that my success has brought a lot of "anons" who throw in the same lame complaints. I have had a lot more trolls and many many people wanting a lot of personal attention in the last year or so. Guess that means people are reading and visiting this blog. If you had read the post, it is very obvious even in this last post, this is about a plea withdrawl. If you want personal, high maintenance attention, you can pay for personal updates and every little detail on a case by including a check with that constructive criticism. I am not against anonymous comments but if you wanted to provide constructive criticism without an agenda and really appreciated my work, you could have addressed this privately and with your real name.

    2. Hey Anon and anybody else who thinks John needs a little "constructive criticism", may I suggest you scroll down to the bottom right of this page to the dates starting with 2011 and start reading. You'll soon understand that this kid has real journalistic talents. One of the many comments that stands out:

Can I just say what a relief to uncover an individual who really knows what they are talking about over
the internet. You actually know how to bring an issue to light and make it important.
More and more people must look at this and understand this side of your story.
I was surprised that you aren't more popular given that you most certainly possess the
      gift.
      I agree wholeheartedly.

    3. Thanks Rusty. This anon plague is all over the country. The "criticism" only shows me I am doing my job and doing it well. There are people like you who contribute to the community and do it without expecting anything.
