"I am asking you to look at Mr. Uber's testimony in the light of all the evidence. The man is broken."




Deputy District Attorney Trent Timm started his rebuttal with addressing Mr. Reavis' dig that the only reason Arcata Fire Department firefighter was called to testify was to elicit sympathy.

"I am not going to put on an arson case without having one of the firefighters, who actually fought the fire testify," said Mr. Timm.

"There is a lot of direct and circumstantial evidence in this case,' said Mr. Timm. "I don't think that Mr. Domenico  should be convicted solely on Mr. Uber's testimony. This case does not hinge on Tommy Uber's testimony"

Mr. Timm brought up the KIEM vidoes that were in direct contrast to what Domenico said to others.

"What does the evidence support? Mr. Timm said there was evidence and other testimony supporting the charges in this case.

"I am asking you to look at Mr. Uber's testimony in the light of all the evidence. The man is broken."

 Reminding the jury that Uber could not even recall how long he had lived at the encampment. Mr. Timm said that you and I would remember but ""His lifestyle has taken a toll on him."

"He got beat up on Thursday and he came back Monday to tell you his story."

Bringing up what Tommy Uber stated on stand, and clarifying that he was not stating this as a put own of Uber, Mr. Timm told the jury, "He is limited emotionally. He is limited intellectually" and that he could not compete with "the intellectual abilities of someone like Mr. Reavis" during cross."

Mr. Timm brought up Jury instruction #105, again about believing all or part of a witness' testimony. He also reminded the jury that Uber had not heard the 911 call or read a transcript and he was cross examined by Mr. Reavis who was reading from the document that Uber had never seen.

  1. John, we are long time manila dwellers. Have had many encounters with uber fam over decades. Tommy and his clan are uber dysfunctional, pardon the pun. Tommy rides his bike daily....we and others have long known about drug dealing and thefts by the uber clan. It is so sad seeing his decline. I wish he were able to better communicate to defend himself. Although the Ubers are a drag on the community, I have not known them to be violent. Just messed up is all.

  2. Uber is not on trial. Mr. Reavis is just doing his job, won't do him much good seeing his client confessed to the crime. A vigorous defense will ensure no appeals.
