John Chiv: No excuses, no continuances, Hale has to surrender on April 13 and finish serving his time in jail

This is the third hearing on the DA's motion to recommit convicted upskirter, sex offender and former court mediator Joseph Hall to jail. I have done two detailed posts. No other media has covered the last two hearings and no other media was not present at this hearing.

Mendocino Judge Ann Moorman and Sonoma County Deputy District Attorney Dale Trigg appeared via Zoom. Mr. Trigg was specially assigned to this case and formerly worked for Mendocino County. Deputy Public Defender Ryan McClurg is representing Hale.

Judge Moorman asked Mr. McClurg why she had not received written material.she asked requested at the last hearing.

"On 3/18, I received hundreds of pages about his Santa Rosa hospitalization," said Mr. McClurg. "After reviewing, I don't see any reason he can't be committed to jail."

Judge Moorman asked for a surrender date. McClurg said April 13. Mr. Trigg had no objection. Mr. McClurg said Hale had one more medical appointment. Unlike other defendants, once again, no written proof has been provided about these medical despite Judge Moorman's request. Mr. McClurg hinted at another delay.

Jane Doe 1 appeared via Zoom and objected to these constant continuances on behalf of all victims and requested remand, even though she said it would not be granted. "This has been going on since June 1 from last year. He keeps putting off these dates. He keeps bringing up medical concerns. I request he be remanded today even though I know that request won't be granted."

"I am emphathetic to the victim's frustration," said Judge Moorman. "No more excuses; no more continuances. He needs to resume serving sentence imposed."

Hale has to surrender to the jail on April 13. Probation resumed today with all previous terms and conditions. Defense request for credits for hospital stay was denied. Mr. McClurg said he couldn't cite authority for a court order that does not exist. And yet, Mr. McClurg bought the court order up at the last hearing and Hale was released by the jail.
