Wallace and Hinz say,"Joe, show me the money"

 


Civil cases in Humboldt Superior court are having dates appear on calendar but are not in e court. This is the case for an order of examination hearing listed in Wallace and Hinz's case vs Joe Mazzotti. There is also a 4/8 date scheduled for an order of examination. Wallace and Hinz is owed $49, 228.29. Who knows when minutes will be in e court so I did some follow up. Today was the date set for Jean Mazzotti’s debtor’s exam. However, since Joe Mazzotti's debtor’s exam is happening on April 8th, and should happen first, today’s exam will be vacated.

Since my last post on this case, I have added minutes from 2/26 and a February 9 order from Judge Timothy Canning.

An order of examination according to the California courts self help website is when "you don't pay what the judge said you owe, the creditor can ask for a debtor's examination. At a debtor's exam, the creditor can ask you questions about your finances. You must answer them. The creditor can use this information to collect the money."

Another case where e court is not updated is the 3/11 hearing on the motion to dimiss by the Wiyot Tribe against Citizens for a Better Eureka. The 3/11 hearing took place.The date is not even listed in e court. There are no minutes for that date. As of today, there is no ruling. 

Civil minutes are always a few dates late but at least hearings and dates should be consistent in e court and the online court calendar. Attorneys, their staff, the media, the public rely on accurate records. Going digital instead of paper calendars would work if it was updated in real time. Again short staffing, inexperienced staff and not enough supervision. There is no use having an information window on the 2nd floor when it is closed. The online court calendar is consistently inaccurate even if a matter has been off calendar for days. 



4/8/24: Finally e court updated to indicate  3/18/24 order of examination hearing off calendar. Today's hearing continued  to 6/3/24. Will the debt be paid by the next hearing?
