Four cases for Damien Carlson resolved with "three years on the bus" plea deal



Attorneys reached a new deal resolving Damien Carlson four cases. Preliminary hearing scheduled for today was vacated.

Change of plea is scheduled before Judge Timothy Canning on July 15. Carlson had a previous plea deal negotiated; then he picked up new charges while he is in custody.

Deputy District Attorney Shelly Small is the prosecutor for the case. Deputy Public Defender David Celli is Carlson's attorney.

Mr. Celli stated the plea deal on record today before Judge Kaleb Cockrum.

In the case ending "in 155," Carlson will plead guilty to an added Count 2 of second degree burglary "for a stipulated mid term of two years." He will also admit the special allegation of "using a deadly weapon" and sentence for that term is one year to be served consecutively.

In the case ending "in 123", his most recent case, Carlson will plead guilty to PC 69 and that time will be served concurrently.

Any time on his felony case, ending "in 225 A" will be served concurrently.

Two drunk in public charges were dismissed. Carlson waived custody credits up to July 6. He will start earning credits, again.

Time waiver was entered by Carlson today. He is still in admin segregation and appeared via video conferencing in a red jumpsuit, shackled and cuffed.

The updates for entry of plea and sentencing will be added to this post, unless something changes.

7/15: Judge Timothy Canning took Carlson's plea. Probation will submit a custody report. It is a stipulated plea and I am not going to do another an update on the sentencing scheduled for August 4.

Deputy District Attorney Carolyn Schaffer appeared via Zoom for the People. Deputy Public Defender David Celli is Carlson's attorney.
