After all the continuances he has requested and for less serious reasons, Russ Clanton's fit about a continuance in Fiore case was unneccessary


Confirmation of an evidentiary hearing and ruling on defense motion to have experts testify remotely was continued to this morning. The People oppose the defense motion.

After remarks by attorneys, the defense motion was granted by Judge Christopher Wilson without prejudice and with a caveat.

Confirmation of the hearing was continued to August 4.  The evidentiary hearing is set for August 10. Once again, Judge Christopher Wilson said he is not sure if the hearing will proceed on that day.

Fiore's attorney is Mr. Russ Clanton. Since Fiore is at High State Desert Prison, his presence has been waived at hearings by Mr. Clanton.

Deputy District Attorney Luke Bernthal will be handling the evidentiary hearing for the People. He was out of the office last week and is still not in the office this week. Today, Deputy District Attorney Steven Steward appeared on the case for the People.

Mr. Steward requested that the hearing be put over to next weeks so either DA Maggie Fleming or Mr. Bernthal could present arguments. Mr. Steward was even willing to argue the People's position tomorrow.
This is not his case so it would require him to familiarize himself with the information and background.

Judge Wilson stated it is a writ of habeas corpus.

Mr. Clanton threw a fit about the continuance.

Judge Wilson said he was going to grant the motion based on the California Chief Justice asking courts to
accomodate remote appearances due to COVID 19.

There are 388 pages of materials and exhibits. Judge Wilson said after witnesses appear, if he feels it is neccessary that they need to be present in person "they can come back"
