Shasta County Sheriff rejects Rory Kalin's case against Judge Gregory Elvine-Kreis




There have been a few developments in the case of Deputy Public Defender Rory Kalin vs. Judge Elvine Kreis.



Kalin is currently on medical leave.

On April 6, 2020 the Shasta County Sheriff’s Office rejected Mr. Kalin’s case after speaking to witnesses at the Memorial Day 2019 lake trip who stated that Judge Elvine-Kreis never made any antisemitic comments towards Mr. Kalin.

Witnesses stated that everyone was pushing each other into the lake and getting pushed into the lake, including Mr. Elvine-Kreis.  Witnesses stated that everyone was having a good time and that Rory Kalin was laughing at the time he was pushed into the lake.  Witnesses stated that Mr. Kalin was never singled out and at no time did the judge ever make rude, inappropriate, or lewd comments to Mr. Kalin or anyone else during the camping trip.

On April 27, 2020 Plaintiff Rory Kalin withdrew his claims that his supervisors ignored harassment or discrimination against him and took part in a cover up to damage his reputation and career.  Mr. Kalin also removed allegations that Mr. Brownfield, his supervisor, did not intervene with regards to demeaning and harassing comments regarding his Jewish heritage.  Plaintiff also removed allegations that his supervisor and other management had made false allegations against him that had allegedly come from the bench.

Judge Elvine-Kreis' attorney Patrik Griego said, "We are concerned that Mr. Kalin is using this lawsuit to obtain money through a go fund me page based on false allegations against Judge Elvine-Kreis.  We look forward to getting this matter to trial so that a jury can hear from each of the witnesses and determine what actually occurred and learn about Mr. Kalin’s motive for bringing these false allegations. "

Mr. Kalin filed a motion to change venue out of Humboldt, which was opposed and the motion was denied.



Defendant's counsel said, "Mr. Kalin did not report the incident to the Shasta County Sheriff’s Department until 8 months after the alleged incident took place and that he only made the report after getting into a conflict at work where his boss had to threaten to call the police if he did not leave the office."

The original complaint was filed on 3/6/20. The supplemental complaint filed on 4/27/20 which removed all the allegations of the alleged cover-up.
