At, further status of preliminary hearing for Demetrius Coleman and Alma Ahumadamendoza today, the preliminary hearing for July 28 was confirmed. Time estimate is 8 hours.
Whether it is a go, will be decided the Friday before the hearing at an informal conference; which has been initiated since the pandemic.
Coleman is charged with murder and special allegation that he personally and intentionally discharged a firearm which caused great bodily injury or death to Johnny Renfro.
Ahumadamendoza is charged as an accessory after the fact in the Rio Dell homicide of Johnny Renfro.
Deputy District Attorney Carolyn Schaffer is the prosecutor for this case.
Ahumadamendoza has been denied OR/release four times. Mr. Feimer filed an application to address her custodial status.
Mr. Feimer said, "in addition to previous aspects raised in previous hearings, she has recently given birth to a newborn child. The child is with her parents in Eureka. She has a sister in Arcata."
Mr. Feimer said her family ties and birth of her child alleviate the flight risk concern. He mentioned "her relative youth and lack of criminal history" and said, "a child should be with his mother."
Mr. Feimer mentioned the "COVID 19 pandemic is worsening." He also said his client was agreeable to electronic monitoring and any reporting ordered by the Court.
Whether it was the fact that it was a new Judge, her latest attorney, sympathy due to COVID, the only change in her circumstance being the birth of her child, today, or all of the above, today was Ahumadamendoza's lucky day.
Judge Timothy Canning granted Mr. Feimer's request and released Ahumadamendoza on OR. "I am a bit concerned that she previously fled to another state," said Judge Canning. The medical issues and the birth of her newborn child were factors in his ruling.
Judge Canning denied Ms. Schaffer's request for supervised release. He did tell Ahumadamendoza that she had to appear for all future court hearings, obey all laws and if she did not, OR bail would be revoked.
