Restitution hearing owed to Tyson Claros' family from Brandon Mitchell, Hector Godoy-Standley and Tamara Thomson was continued to this afternoon. It was continued again.It didn't even start until after 2 p.m. and was scheduled for 1:30. Saw Judge Wilson come in shortly before 2 p.m. The defendants and all attorneys were present.
Mitchell is represented by Ms. Andrea Sullivan, Godoy-Standley is represented by Mr. Russ Clanton and Thomson by Mr. David Nims.
Ms. Sullivan and Mr. Clanton were in court. Mr. Nims appeared via Zoom.
Deputy District Attorney Carolyn Schaffer appeared via Zoom.
Judge Christopher Wilson has been asking for specific amounts, written information and again asked for a spreadsheet.
I am not going to keep covering this restitution hearing in such detail as this and previous posts.
In the probation report, $24,136 is being requested which includes funeral expenses, lost wages and counseling. Claros' family members were present via Zoom and ready to testify today. Ms. Schaffer also had exhibits which she emailed to defense in court at the hearing.
Mr. Nims said if they had the contested hearing today, "I would have to fly by the seat of my pants" and requested Judge Wilson not issue any ruling until he has a chance to respond via written brief.
Ms. Sullivan said unlike probation, when someone is sentenced to prison, there is limited liability. She also said an evidentiary hearing was neccessary to determine statutory eligibility.
The hearing was continued to August 17 so Ms. Schaffer could meet Claros' family members, get Judge Wilson and defense the information requested and streamline the restitution and hopefully arrive on a stipulated amount.
