DA's motion to amend charges for attempted murder suspect Matthew Ramsey granted


Trial confirmation and ruling on a motion to  file first amended information was continued to this morning for attempted murder suspect Matthew Ramsey.

Mr. Russ Clanton is Ramsey's attorney. At the last hearing, Ms. Sara Zalkin appeared in court for him.  She said, "Mr. Clanton asked me to object to the timeliness of the motion." She did not know if Mr. Clanton planned to file a written opposition to the first amended information but she said defense would file a 995 motion.

Today, Mr. Clanton objected, again to the timeliness of the motion. He said the opportunity to address some issues is lost because the preliminary hearing "has already taken place."

Deputy District Attorney Candace Myers appeared on the case for the People today. She said the attorney assigned to the case believes the amended information "is reflective of what the attorney believes was proved at the preliminary hearing. Defense can file a 995 motion"

The motion for first amended information was granted by Judge Canning. The alleged victim is Joshua Thomas Spaulding II.

Count 1 is PC 664/187(a), attempted murder.

Special allegation for Count 1:  personal intentional discharge of a firearm causing  great bodily injury/death. Weapon .17 Winchester Super Magnum rifle.

Count 2 is PC 245( b) assault with semi automatic firearm.

Special allegation for Count 2: during commission of crime personally inflicted great bodily injury

Special allegation for Count 2: firearm used in the commission of crime

Not guilty pleas and denial of all special allegations were entered on the amended complaint.

Mr. Clanton said "after an independent  psychological report" and talking with Ramsey's mother and the defendant himself, Ramsey was going to enter an additional plea of not guilty by insanity today.

Dr. Mikel Matto was appointed today. Ms.Myers objected to the appointment of Dr. Martin Williams and said the People would submit a recommendation for a second doctor.

Jury trial scheduled for August 3 in the 2018 case was vacated. Appointment of second doctor is scheduled for August 7. I will add that name to this post.

Ramsey had a second 2020 case on calendar. In that case, he is charged with PC 4600 (a), damage to prison or jail property. That case "trails" the 2018 case snd was on for pre trial today.

8/7: Dr. Andrew Renouf was the second doctor appointed for Ramsey. Receipt of his report is due August 31.
